Three TNI Soldiers Killing Imam Masykur Demanded The Death Penalty
The three TNI soldiers who were accused of the premeditated murder case against Imam Masykur were demanded the death penalty by the Jakarta Military Authority.
This was conveyed by the Military Prosecutor Lt. Col. Chk Upen Jaya Supena when reading the demands in a follow-up hearing at the Military Court II-08 Jakarta, Cakung, East Jakarta, Monday, November 27.
"The defendant one (Praka Riswandi Manik) is the main sentence of the death penalty, the defendant two (Praka Heri Sandi) is the main penalty of the death penalty and the defendant three (Praka Jasmowir) is the main sentence of the death penalty," Jaya said as quoted by ANTARA.
The three defendants also received additional punishment, namely being fired from military service, especially the Army.
Praka Rismwandi Manik is a member of Paspampres, Praka Heri Sandi is a member of the Topographic Directorate of the Indonesian Army and Praka Jasmowir is a member of the Iskandar Muda Regional Military Command.
The Military Oditur hopes that the panel of judges will find the defendants guilty because they jointly committed the criminal act of premeditated murder as stated in Article 340 of the Criminal Code in conjunction with Article 55 paragraph (1) 1st of the Criminal Code
The panel of judges at the Military Court II-08 is also expected to find the defendants guilty because they jointly carried out the kidnapping as stated in Article 328 of the Criminal Code in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.
According to him, things that burden the defendants, among others, the defendant's actions are against the law (UU), acts that violate the Sapta Marga and the Soldier's Oath and the Eight Mandatory TNI.
"The defendant's actions tarnished the good name of his unit, the defendant's actions were far from inhumane because he had reached the heart to kill humans, namely Imam Masykur and the defendant's actions were sadistic," said Jaya.
Meanwhile, there were no mitigating factors for the defendants.
After listening to the demands of the Military Oditur, the panel of judges led by Colonel Chk Rudy Dwi Prakamto gave the defendants the opportunity to file a defense (pledoi) against the demands of the Military Oditur.
"I give the defendants one week to prepare a pledoi. The trial will continue on December 4, 2023 with the agenda of reading the defendants' defenses," said Rudy.
The criminal act took place on August 12, 2023 and the victim's body was dumped at 01.00 WIB August 13, 2023 in the Purwakarta area, West Java.
Imam Masykur's body was found by a 9-year-old child in the Citarum River. Imam's body was found caught in a hyacinth on the surface of the river which is about five meters deep.
The child reported to adults around the river, namely Perum Jasa Tirta who rested around the riverbank.

The family of Imam Masykur reported the kidnapping and torture of Imam to the Polda Metro Jaya. The report from the family was based on the contents of the message, telephone and video call from the victim and the perpetrators to the Imam Masykur family when the torture and kidnapping took place.
The report was received by the police with the Number STTLP/B/4776/VIII/2023/SPKT. From the victim's family report to the police, the Military Police of Kodam Jaya started the legal process for the three TNI AD soldiers on August 14, 2023.
The three soldiers are known to have extorted and kidnapped cosmetic shopkeepers around Jabodetabek, including Imam Masykur. The cosmetic shop is a cover to sell G-class drugs (hard drugs that require a doctor's prescription) illegally.
It is believed that Praka Riswandi and his friends often target illegal drug shops under the guise of cosmetic shops to extort sellers or shopkeepers.
