HGB Period Ends, PT Indobuildco Asked To Empty The Sultan Senayan Hotel Land Which Will Be Managed By The Government
Coordinating Minister for Political, Legal and Security Affairs Mahfud MD asked PT Indobuildco to vacate the Sultan Hotel area in the Gelora Bung Karno (GBK) area, Senayan, Jakarta.
"Yes, we hope that it will be vacated properly. Later the emptying process will be carried out through persuasive law enforcement," said Mahfud at the Coordinating Ministry for Political, Legal and Security Affairs Office, Jakarta, Friday, September 8, which was confiscated by Antara.
Meanwhile, PT Indobuildco no longer has the right to land covering an area of approximately 13 hectares, after the Indobuildco Building Use Rights (HGB) No. 26/Gelora and GBK Indobuildco No. 27/Gelora were exhausted.
HGB No. 26/Gelora has ended on March 4, 2023 and HGB No. 27/Gelora ends April 3, 2023. Land management is then authorized to the Ministry of State Secretariat in accordance with the 1989 HPL 1/Gelora issued by the Ministry of ATR/BPN.
According to him, the handover of the management of the land must be carried out because the government has won the lawsuit in court.
Based on the court's decision, PT Indobuildco lost even though it had filed a civil lawsuit in court until the Judicial Review (PK) four times. The company again filed a lawsuit with the State Administrative Court (PTUN) 2023.
"Many times, losing is no longer possible to enter the Administrative Court. And brothers, we are of the opinion that the PTUN business will let it run because this is a civil matter that has been completed," he said.
Not only that, Mahfud assessed that the lawsuit filed by PT Indobuildco to the Administrative Court was only buying time. However, he still respects that.
"However, the civil data has passed three to four months ago," Mahfud explained.
He said there are still many state assets that have been controlled by the private sector or individuals against the law.
For this reason, this issue can be a momentum in explaining to the public that the state has assigned all relevant officials the task of saving all state assets that have been controlled by the private sector.
"We have repeatedly reminded them to be returned carefully," he said.
Previously, on Friday, March 3, the Ministry of State Secretariat (Kemensetneg) formed a Management Transition Team for Block 15 of the Bung Karno Gelora Complex Management Center (PPK GBK) or the area currently occupied by the Sultan Hotel.
This was followed by the decision of the PK for land disputes in Block 15 of the GBK area which was won by the government from PT Indobuildco. Furthermore, the government through the Ministry of State Affairs will manage the area itself.
"In line with the Central Government's plan to revitalize the GBK area for the benefit of the state, both sports and non-sports as well as various state and international activities, the Ministry of State Secretariat has formed a Block 15 Management Transition Team for PPK GBK Areas to utilize land for the benefit of the state," said Deputy Minister of Law and Human Rights as well as Chairman of the GBK PPK Supervisory Board Edward Omar Sharif Hiariej in a press statement at the Ministry of State Secretariat Office, Jakarta, Friday 8 September.

On the same occasion, Secretary of the Ministry of State Secretariat Setya Utama said that the formation of the transition team was a decision from the Minister of State Secretary (Mensesneg) Pratikno.
"The leader has decided with the end of HGB No.27/Gelora and No.26/Gelora will manage it themselves, so Kemensetneg will manage its own, in this case PPK GBK," said Setya.
Setya also said that in accordance with applicable regulations, management can be collaborated with other parties who are considered to have competence in managing areas, hotels, and assets located on HPL No. 1/Gelora, including Block 15 or currently occupied by Hotel Sultan.
According to Setya, the Ministry of State Secretariat and PPK GBK will further explore the management plan of Block 15 HPL 1/Gelora starting with physical checks and audits from the Financial and Development Supervisory Agency (BPKP) and the Public Appraisal Service Office (KJPP).
