President Director Of BTM Sentenced To 6 Months In Prison In Illegal Gold Mining Case In Sekatak

TANJUNG SELOR - The panel of judges at the Begeri Court (PN) of Bulungan Class I B, North Kalimantan (Kaltara) sentenced two defendants, namely Nurawa and Ahmad Jailani, in a trial in the case of gold mining without a permit (PETI) in Sekatak District.

Head of the General Crime Section (Kasi Pidum) of the Bulungan Kejari, Muhammad Faizal, said that in addition to the prison sentence, the two defendants were asked to pay a fine of Rp. 50 million or a subsidiary of six months in prison.

"The defendant Ahmad Jailani is two months lower than the demands of the public prosecutor who demanded eight years in prison," said Faizal, quoted on Thursday, September 7.

Faizal explained that Ahmad Jailani was the owner of the company or third party that produced gold mining on PT BTM's concession land.

"Well, the activity carried out by Ahmad Jailani was without being equipped with an IUJP (mining service business permit)," he said.

Ahmad Jailani was found guilty of violating Article 158 of Law (UU) Number 3 of 2O2O concerning Amendments to Law Number 4 of 2OO9 concerning Mineral and Coal Mining (Minerba) junto Article 55 Paragraph 1 of the 1st Criminal Code (KUHP) and Article 161 of Law Number 3 of 2O2O in conjunction with Article 55 Paragraph 1 of the Criminal Code.

"Regarding light punishment In this case, we do not speak lightly or heavily. However, we are talking about what the defendants did," he said.

Faizal explained that Nurawa as the President Director (Director) of PT BTM had issued a work order (SPK) to Ahmad Jailani. In this process, it was found that BTM already has a Production Operation Mining Business License (IUP OP).

"However, according to regulations, after having an OP IUP, you cannot immediately carry out production activities," he said.

Because, there are still some requirements that must be met. One of the conditions has not been met by BTM. Namely, the monthly work plan (RKB). Then, Ahmad Jailani who manages in the BTM conservation area does not have an IUJP.

"For evidence in the form of heavy equipment, according to the decision to release the judge, it was returned to the owner. Because the heavy equipment was rented," he concluded.
