Corruption Of Hundreds Of Millions, Village Head And Village Treasurer In South Nias Sued 6 Years In Prison
The Public Prosecutor (JPU) from the South Nias District Attorney demanded the former Acting (Pj) Head of Lahusa Fau Village, Fanayama District, South Nias Regency (Nisel) Antonioman Manaraja and treasurer Berkat Telaumbanua for six years in prison in a corruption case.
"In addition, the defendant was fined Rp. 200 million, or if the fine was not paid, it was replaced with imprisonment for 3 months," said Public Prosecutor Bobby Virgo in Medan as reported by ANTARA, Monday, June 5.
From the facts of the trial, the defendant is considered to have fulfilled the elements of committing a criminal act Article 2 paragraph 1 in conjunction with Article 18 of Law Number 20 of 2001 amendments to Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph 1 of the Criminal Code.
The elements that are met are ordering or participating in doing without rights, and against the law enriching oneself, others or corporations which resulted in state financial losses of Rp509,157,305 for the 2018 village fund budget.
"The aggravating thing for the two defendants did not participate in the government's program in eradicating corruption, costing state finances Rp509,157,305 million, while the mitigating factors between the two defendants were cooperative and never punished," said Bobby.

In addition, the Public Prosecutor said Antonioman was charged a replacement money (UP) of Rp272,761,325, while Thanks to Telaumbanua Rp217,395,980 for having paid Rp19 million, provided that a month after the case had permanent legal force, his property was confiscated, then auctioned off.
"If later it is also not sufficient to cover the UP, then the two defendants will be replaced with imprisonment for 3 years," said the Public Prosecutor.
After hearing the memorandum of demand from the Public Prosecutor, the Panel of Judges chaired by Sulhanuddin continued the trial on June 15, 2023 to hear the submission of a memorandum of defense (pledoi) from the defendant and his legal adviser (PH).
