Father Kills Biological Child In Gresik Must Be Strictly Punished
JAKARTA - The Ministry of Women's Empowerment and Child Protection (PPPA) encourages law enforcement to ensnare perpetrators of violence against biological children to death in Gresik, East Java, with severe penalties in accordance with applicable laws and regulations.
"I hope that law enforcement officials can continue to investigate this case, including the motive, and ensnare the perpetrators with severe punishment according to the law," said Deputy for Child Special Protection of the Ministry of PPPA Nahar to ANTARA in Jakarta, Thursday, May 4.
Nahar said this incident raised deep concern, because of the tragic fate experienced by the child who died at the hands of his own parents as the party who should provide the best love and care for his child.
"I am very concerned and express my deepest condolences for the death of AK, who is still 9 years old, because he was stabbed by his own biological father, MQA (29). This incident is very tragic considering that children should get good love and care from their parents," said Nahar.
Regarding the threat of punishment for the perpetrators, Nahar said that the perpetrators could be charged with Article 80 Paragraph (3) and Paragraph (4) jo. 76C Law Number 35 of 2014 concerning Child Protection, which carries a maximum imprisonment of 15 years and a maximum fine of IDR 3 billion and a sentence of a third added, because the perpetrators are the parents of the victims.

Perpetrators can also be subject to Article 44 Paragraph (3) of Law Number 23 of 2004 concerning the Elimination of Domestic Violence with a maximum imprisonment of 15 years and a fine of IDR 45 million.
In addition, according to him, the perpetrators can also be charged with Article 340 of the Criminal Code (if planned) and/or Article 338 of the Criminal Code related to the crime of murder with the threat of death penalty or life imprisonment or for a certain period of a maximum of 20 years.
