Former Member Of The Bima DPRD Corruption Rp862 Million, Sued Two Years In Prison
MATARAM - A former member of the DPRD of Bima Regency, West Nusa Tenggara, Boymin who became a defendant in the 2017-2019 Community Learning Activity Center (PKBM) program corruption case with a state loss of Rp862 million was sentenced to two years in prison.
"Ask the panel of judges to sentence the defendant Boymin to two years in prison," said Septian Heri Saputra representing the public prosecutor's team when reading the charges at the Corruption Crime District Court, quoted by ANTARA, Tuesday, February 28.
In addition to criminal penalties, the public prosecutor (JPU) asked the panel of judges to impose a fine of Rp. 50 million, subsidiary to six months in prison.
The prosecutor in his claim also asked the panel of judges to pay compensation of Rp. 762 million, subsidiary to 10 months in prison. The replacement money was reduced by the money previously deposited by the defendant in cash to the prosecutor in the amount of Rp. 100 million.
For a land certificate in the name of the defendant covering an area of 7.4 hectares in Mawu Village, Bima Regency, which was entrusted to the prosecutor during the trial, it was requested to be confiscated and auctioned off by the state for further use as a cover for the lack of money to compensate for state losses.
The prosecutor determined such charges by stating that the defendant's actions had been proven to have violated the subsidiary charges, namely Article 3 in conjunction with Article 18 paragraph (1) letters a and b, paragraph (2), paragraph (3) of Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Eradication of Criminal Acts of Corruption in conjunction with Article 65 paragraph (1) 1st of the Criminal Code.
In the description of the charges, the defendant Boymin acted as Chairman of the PKBM Karoko Mas located in Nanga Wera Hamlet, Wera District, Bima Regency.
With this capacity, Boymin is suspected of being the main actor who resulted in state losses in managing PKBM program funds from 2017 to 2019.
The prosecutor assessed that Boymin had abused his authority as Chairman of the PKBM Karoko Mas by enriching himself to cause state losses.
Based on the results of an audit by the NTB Representative Financial and Development Supervisory Agency (BPKP), the value of state losses is at least Rp. 862 million from the total three-year budget management of Rp. 1.44 billion.
