Hasya Athallah Has Died, It Is Better If The Suspect's Status Is Revoked And His Name Is Rehabilitated
Member of Commission III of the DPR, Habiburokhman, suggested revoking the status of suspect Hasya Athallah, a student at the University of Indonesia (UI) who died in an accident involving retired Police officers.
"What's difficult is. After all, the case has been stopped. Moreover, the status of the suspects is sufficient to be declared revoked, so the good name of the deceased can be rehabilitated," said Habiburokhman at the Senayan Parliament Complex, Jakarta, Thursday, February 2.
This Gerindra politician said, Article 77 of the Criminal Code explains that the authority to demand the law is null or void if it is accused of death.
"Well, we haven't heard of the removal of the suspect's status until now, even though the case is said to have been stopped," he said.
In addition, investigators should pay attention to the decision of the Constitutional Court (MK) Number 21/PUU-XII/2014 dated April 28, 2015, which stipulates that before determining the suspect, it must be preceded by examining the potential suspect.
Habiburokhman, the performance of the Polda Metro Jaya, which has been built so far, has not been tarnished due to an error in handling traffic accidents involving retired Polri and UI students.
"There is no need to go through pretrial, it has been declared that the status of the suspect is not present. What is the suspect? The person in the case is not there, of course the suspect is not there, and it needs to be narrated by friends from the Ditlantas Polda Metro Jaya," he said.
In line with Habiburokhman, Member of Commission III Taufik Basari also suggested that the status of suspect Hasya Athallah be revoked first.
"Forgot it first, if an expert says to revoke the SP3, it must be with a pretrial lawsuit, that's wrong, if it's like this, it's clear why the determination of the suspect is wrong," he added.
In addition, he also encouraged the police to be able to see this case comprehensively, as well as investigators to carry out the instructions of the National Police Chief to be professional and prioritize humanity in handling this case.
"It's not just that I did a case again, reconstruction was just to show what happened, the position of the car, the position of the motorbike, after that, we saw who was in the wrong position, not just that," he said.
Hasya Athallah's accident with retired police officer AKBP Eko Setio occurred last Thursday, October 6, at around 21.30 WIB, on Srengseng Sawah Street, Jagakarsa, South Jakarta. When the incident happened, the weather was raining and the road was slippery.
Dirlantas Polda Metro Jaya Kombes Latif Usman explained that the incident began with victim Hasya who was traveling from south to north at a speed of 60 km/hour.
Based on the testimony of the witness who was the victim's friend, there was a vehicle that suddenly turned. Victim Hasya immediately avoided by suddenly stopping her vehicle. As a result, the victim slipped and entered another road.
"So his friend himself explained that at that time suddenly there was a vehicle in front of him (the victim) wanted to turn right so the victim made a sudden braking," said Latif.
At the same time, from the opposite direction, a Pajero car arrived driven by Eko who was said to be traveling at a speed of 30 km/hour. He could not avoid the accident, causing Hasya to get hit.
"Well, Mr. Eko at this time can't avoid it because it's close. So it's not a collision with a Pajero vehicle, but it fell to the right and was accepted by Pajero, so an accident occurred," he concluded.
The police have finished reconstructing the case of the death of an University of Indonesia (UI) student, M Hasya Attalah Syahputra, involving AKBP (Ret.) Eko Setio. It is known that the reconstruction was held on Srengseng Sawah Street, Jagakarsa, South Jakarta.
