The Ministry Of Law And Human Rights Denies That There Is A Death Penalty For Buying And Selling In The New Criminal Code

TANGERANG - The Ministry of Law and Human Rights (Kemenkumham) denies buying and selling sentences related to the latest death penalty book (KUHP).

Acting (Plt) Director General of Legislation at the Indonesian Ministry of Law and Human Rights, Dhana Putra explained that in the application of the cancellation of the death penalty there would be a death penalty, if the convict could behave well and there was a desire to change during the 10-year probation period.

It is known, Article 100 of the Criminal Code reads, "The judge sentenced the defendant to death with a probationary period of 10 years by paying attention: a. The defendant's regret and there is hope to improve himself; or b. The defendant's role in a criminal act

"First, the death penalty is given a probationary period of 10 years, if their 10 years change from behavior, then they can be passed to life," Dhana told reporters at Poltekim and Poltekip Tangerang, Thursday, December 15.

Nevertheless, Dhana denied that the application of the death penalty to the latest Criminal Code would be a field of corruption or buying and selling sentences from the Kalapas and prison officials.

He emphasized that if that would not happen. The reason is that in the process of providing recommendations for the cancellation of the death penalty, later there will be a special team that will assess the convict.

As for those who later recommend the cancellation of the death penalty, namely the correctional element, the Ministry of Institutions, the Psychologist team.

"So it doesn't necessarily mean that the changes are directly recommended from Kalapas. At least the elements are from prisons, there are also from the community, psychologists also exist, and the ministry of institutions," he concluded.

As is known, Lawyer Hotman Paris Hutapea criticized the new rules regarding the application of the death penalty contained in the latest Criminal Code.

According to him, the death penalty regulated in Article 100 of the Criminal Code does not make sense because it regulates the probationary period of 10 years in prison for the convicts.

For him, this could be a business game gap for the Heads of Prisons in various parts of Indonesia. The reason is that with a recommendation letter from Kalapas, the death penalty can be annulled by the criminal sentence.
