Mahfud: The Handling Of The Case Of The Coordinating Ministry For Cooperatives Of SMEs Is Continued
Coordinating Minister for Political, Legal and Security Affairs Mahfud MD emphasized that the handling of the rape case of employees of the Ministry of Cooperatives and SMEs (Kemenkop UKM) by four of his co-workers continued.
This was because the order to stop the investigation (SP3) of the case was canceled after Mahfud held a meeting with LPSK, the Head of the Criminal Investigation Unit, Komjen Pol. Agus Andrianto, Kompolnas, prosecutor's office, Kemenkop UKM at the Coordinating Ministry for Political, Legal and Security Affairs Office, Jakarta, Monday, November 21 yesterday.
"Therefore, the four suspects and three witnesses, namely N, MF, WH, ZPA (suspects), then the witnesses who were also considered involved, A, T, and H, should be processed to court," Mahfud said as quoted by Antara, Tuesday, November 22.
The case had stopped because it received SP3 on the grounds that the report had been withdrawn.
Mahfud explained the reason for SP3 because the revocation of the report was not legally true. In the law, the report cannot be withdrawn, while the complaint can be withdrawn.
"If the report is reported, the police must judge. If there is not enough evidence, the case will be stopped without being revoked. However, if there is sufficient evidence even though the reporter states that the withdrawal, the case must be continued. It is different from the complaint based on the complaint offense. If the complaint, as the complaint complains to withdraw, the case will be closed," said the former Chief Justice of the Constitutional Court (MK).
Mahfud emphasized that there is no concept of restorative justice in serious crimes. Therefore, the case must continue to be brought to court.
"For serious crimes, the threat, for example, is more than 4 years or more than 5 years, there is no restorative justice," he said.
He mentioned corruption, theft, murder, and robbery without restorative justice. It must continue to be brought to court.
"Because there are many who are misguided. There are people caught in corruption, then ask for restorative justice. There is no restorative justice in crime," said Mahfud.
A female employee of the Kemenkop UKM with the initials ND was reportedly raped by four of her co-workers while traveling outside the city. This rape took place in a hotel, Bogor area, West Java, December 6, 2019.
