The Sebakung Jaya Village Fund Reduction Case Prosecutor's Office For Alleged Misappropriation Of The Sebakung Jaya Village Fund
The North Penajam Paser District Attorney's Office has filed a case of alleged misappropriation of the use of the 2019 Village Fund in Sebakung Jaya Village, Babulu District, North Penajam Paser Regency at the Samarinda Corruption Court, East Kalimantan. "We have transferred the alleged misappropriation file of the Village Fund in Sebakung Jaya Village, Babulu District to court, because it has fulfilled the elements of a criminal act of corruption," said Head of the Special Crime Section of the North Penajam Paser Kejari, Mosezs Manulang, quoted by Antara Sunday.
The suspect is subject to Article 2 paragraph 1 in conjunction with Article 18 of Law of the Republic of Indonesia Number 3 of 1999 in conjunction with Law Number 20 of 2021 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption, in conjunction with Article 55 paragraph 1 subsidiary Article 3 in conjunction with Article 18 of Law Number 31 of 1999, in conjunction with Law Number 20 of 2001, in conjunction with Article 55 paragraph 1 of the Criminal Code. In that case, the threat of a minimum sentence of four years or a maximum of 20 years in prison, as well as a fine of at least Rp. 200 million and a maximum of Rp. 1 billion.
Dalam kasus tersebut, penyidik Kejari Penajam Paser Utara menetapkan anggota tim pelaksana kegiatan pembangunan lagi sepak bola Desa Sebakung Jaya berinisial Ham sebagai tersangka.
Ham is suspected of purchasing fictitious pile land on the Sebakung Jaya Village soccer field construction project in 2019 using the Village Fund.
From the search results, it is known that the pile-up land for the construction of football fields has never been purchased, but in the activity report there was a payment for the purchase of pile-up land. North Penajam Paser investigators also appointed the former village head (Kades) Sebakung Jaya with the initials Muh, who at that time ordered the village treasurer to pay the pile-up land directly to members of the implementing team with the initials Ham. Payment should have been from the treasurer to the section head or head of affairs that oversee development activities, then conduct a field review before issuing the budget.
"Ham and Muh are involved, all evidence has been obtained to ensnare the two suspects and the first trial is estimated to be November 2022," said Mosezs Manullang.
