Knock! Supreme Court Rejects Cassation, Prosecutors Still Imprisoned For 6 Years In Drug Cases

JAKARTA - The Supreme Court (MA) has finally rejected the lawsuit in the criminal case of abusing dry marijuana with the convicted prosecutor on behalf of Stepanus Peter Imanuel alias Steven.

"Of course, with the issuance of the Supreme Court's decision, it has legal force, because before an appeal was made at the Supreme Court, the convict Stepanus Peter Imanuel alias Steven had been sentenced by the Ternate District Court Judge to a prison sentence of 6 years and a fine of Rp. 3 billion," said Public Relations of the District Court. (PN) Ternate, Kadar Noh, in Ternate, North Maluku (Malut), quoted from Antara, Thursday 11 August.

He confirmed that the information on the appeal of the alleged drug abuse case had been dropped from the Supreme Court. In its decision, the Supreme Court stated that it rejected the cassation of the convict Stepanus Peter Imanuel alias Steven and upheld the decision of the High Court.

So, for this decision, the convict then filed an appeal at the High Court (PT) with file number W28-U2/147/HK.01/1/2022, here the PT Judges even added a mass sentence against the convict Stepanus Peter Imanuel alias Steven from 6 years to 10 years 6 months in prison and a fine of Rp. 3 billion with the condition that if not paid, it is replaced with a prison sentence of 4 months as stated in the appeal decision 4/PID.SUS/2022/PT Ternate.

Therefore, because this individual prosecutor was not satisfied with the PT's decision, the convict Stepanus Peter Imanuel alias Steven then filed a legal cassation at the Supreme Court as evidenced by the cassation file number W28-U2/577/HK.01/3/2022, at this last level. The Panel of Judges of the Supreme Court decided to reject the appeal of the convict and the decision of the cassation was the same as the decision of appeal in the High Court.

He added that in this case, both the Public Prosecutor of the Ternate District Court and the convict Stepanus Peter Imanuel alias Steven all made an appeal to the Supreme Court, but the cassation of the convict was rejected by the Supreme Court of Justice.

Meanwhile, the Head of the Ternate Intelligence Section (Kasi) Aan Syaeful Anwar, when confirmed separately, confirmed that the cassation decision from the Supreme Court had been handed down.

Syaeful stated, for the cassation to be received, a summons will be made for the convict Stepanus Peter Imanuel alias Steven for the execution process and a summons will be made for the person concerned.

Syaeful explained that if the convict did not attend the summons according to the procedure three times, then his party would take coercive measures.
