Anies Urged To Revoke The Gubernatorial Regulation On Forced Evictions Made By Ahok, This Is The Development In The Provincial Government
JAKARTA - Head of the Jakarta Legal Bureau, Yayan Yuhanah, has ensured that the DKI Provincial Government will follow up on the demands of a group of people for Governor Anies Baswedan to revoke Governor's Regulation (Pergub) Number 207 of 2016 concerning Control of Land Use/Control without Entitled Permits.
Gubernatorial Regulation 27/2016 was issued by Basuki Tjahaja Purnama alias Ahok while serving as Governor of DKI in 2016. Ahok often uses this regulation to carry out forced evictions.
"It is being processed. If there is input from the public to review a regulation, we will examine it, whether it is still appropriate, whether it is still needed," Yayan said when contacted by VOI, Monday, August 8.
Although he has processed the claim, Yayan is not sure whether the DKI Provincial Government will revoke Pergub 207/2016 or not.
He continued, the current governor's regulation drafting program requires a study that considers the urgency of the regulation itself.
"Later, it will be evaluated first whether it is revoked or not, it is being processed. Because to revoke or draw up the Pergub, there must be a plan," said Yayan.
Not to mention, any planning to revoke or revise the governor's regulation, to the formation of a new governor's regulation, must pass the consideration and approval of the Ministry of Home Affairs (Kemendagri).
"If it is not included in the planning, the Ministry of Home Affairs will reject it. Because we have to do facilitation at the Ministry of Home Affairs," he said.
Previously, a group of people on behalf of the People's Coalition Against Eviction (KRMP) visited the DKI Jakarta City Hall to collect Anies' promise to revoke Pergub 207/2016.
Because, when Anies served as Governor of DKI in 2017 until now, the governor was still being used by him to carry out forced evictions. In fact, this is not in accordance with Anies' narrative during the 2017 Pilkada campaign, which did not want to evicte residents' settlements.
The evictions that used the governor's regulation during Anies' leadership of DKI took place at Pancoran Buntu II, South Jakarta; Vegetable Garden, Ciracas, East Jakarta; Bukit Duri, Tebet, South Jakarta; and Sunter Agung, Tanjung Priok, North Jakarta.
KRMP representative and LBH Jakarta public attorney, Jihan Fauziah Hamdo explained the reason his party demanded Anies revoke Pergub 207/2016. The evictions that used the governor's regulation during Anies' leadership of DKI took place at Pancoran Buntu II, South Jakarta; Vegetable Garden, Ciracas, East Jakarta; Bukit Duri, Tebet, South Jakarta; and Sunter Agung, Tanjung Priok, North Jakarta.
"There are seven reasons why the gubernatorial regulation should be revoked. The first is that this regulation is a form of vigilantism. The second is to bypass the legislature that has been mentioned earlier. ," explained Jihan, some time ago.
"Fourthly, this regulation violates AUPB. Fifth, it violates citizens' constitutional rights. Sixth, it violates human rights. Lastly, this use was conveyed because it was derived from Perppu 51 of 1960, which became the basis for the formation of a governor's regulation. It does not meet the needs of the people of DKI Jakarta. So, the revocation of this regulation must be carried out," he added.
