Answering Mardani Maming's Allegation Of Pretrial Sabotage Through DPO, KPK: The Legal Mechanism Has Been Passed
JAKARTA - The Corruption Eradication Commission (KPK) emphasizes that the applicable law always takes precedence in carrying out its duties. Including when publishing a wanted list (DPO) on behalf of the former Regent of Tanah Bumbu Mardani H. Maming.
This was conveyed in response to allegations that Mardani's attorney, Denny Indrayana, said that the pretrial at the South Jakarta District Court (PN) was sabotaged by the KPK.
"We make sure that every Corruption Eradication Commission (KPK) resolves cases at the investigative, investigative, and prosecution levels, always follows the rules of applicable law," said Acting KPK Spokesperson for Enforcement, Ali Fikri, to VOI, Wednesday, July 27.
"Even in determining the DPO, of course it has gone through the mechanism of the legal procedure process as well as the criminal procedure law and other legal mechanisms," he continued.
The determination of the DPO, said Ali, is also a form of the KPK's seriousness in investigating allegations of bribery and gratification related to the mining business permit (IUP) that ensnared Mardani.
Furthermore, the KPK is still waiting for Mardani's arrival at their headquarters on Thursday, July 28. They were asked to be consistent in their statement.
"We hope that the attorney will fulfill the promise that has been made to the public to attend the KPK suspecting MM as the suspect tomorrow, July 28, 2022," he said.
After the pretrial hearing at the South Jakarta District Court, Denny Indrayana, who is Mardani's attorney, accused the KPK of sabotage by setting his client as a fugitive through the publication of a wanted list (DPO).
"This (determination of fugitives, ed) could be a real sabotage for the pretrial process," Denny told reporters at the South Jakarta District Court, Wednesday, July 27.
Denny claims that his client was not uncooperative when he was absent from the KPK's summons. He said a letter requesting a rescheduling had been sent to the anti-corruption commission.
Denny said that Mardani had sent a letter stating that he would attend on Thursday, July 28 or the day after the pretrial verdict was read out.
Furthermore, the Mardani camp also felt disappointed with the decision of the single pretrial panel of judges. All steps to fight the KPK in pretrial have been prepared but not effective because his client has already been declared a fugitive.
Mardani H. Maming filed a pretrial because he felt he was criminalized after being named a suspect in the alleged bribery and gratification of the mining business permit (IUP) in Tanah Bumbu, South Kalimantan.
However, the judge decided to reject the application. The reason is that the Corruption Eradication Commission (KPK) has complied with the law when it named the PBNU General Treasurer as a suspect.
