Ministry Of PPPA Highlights Defendant Of Obscenity Case At SPI Batu City Not Detained

JAKARTA - Deputy for Special Child Protection at the Ministry of Women's Empowerment and Child Protection (PPPA), Nahar, said that his party regretted that JE, the accused perpetrator of sexual violence at an educational institution in Batu City, East Java, was not detained since the beginning of the legal process.

"The suspect JE has not been detained since the investigation until now in the trial process at the Malang District Court. If the threat of punishment is more than five years, he should be detained", said Nahar as quoted by ANTARA, Monday, July 11.

He said that in this case of sexual violence, the suspect should have been detained from the start because the penalty was more than five years in prison by Article 21 paragraph (4) of Law no. 8 of 1981 concerning the Criminal Procedure Code.

The case is currently being tried at the Malang District Court which is being carried out behind closed doors considering the case of decency, as regulated in the provisions of Article 153 Paragraph 3 of the Criminal Procedure Code (KUHAP).

The plan is that on July 20, 2022, the trial will continue with the agenda of reading criminal charges by the East Java High Prosecutor's General Prosecutor Team (JPU) and the Batu District Attorney, then the next session with the agenda for submitting a defense (Pledoi) for the prosecutor's criminal charges, by a team of legal advisors. defendant J.E.

"A total of 15 victim-witnesses have been asked for statements since the examination at the Batu Police and during the trial. Although only 15 victim-witnesses were asked for information, it is suspected that there were more than 15 victims", said Nahar.

Nahar said the PPPA Ministry encourages the legal process to run by applicable laws and regulations, in particular, Article 76D and 76E of Law 35 of 2014 and Articles 81 and 82 of Law 17 of 2016 concerning Child Protection with a minimum penalty of five years in prison and a maximum of 15 years in prison and can be plus 1/3 because the suspect is a school teacher/caregiver.

He added that since receiving the report on the sexual violence case, the PPPA Ministry has carried out outreach and assistance through the Assistant Team of Deputy for Child Services in Need of Special Protection (AMPK) to Batu City with the Psychologist Team from the Indonesian Psychological Association (HIMPSI) East Java.
