Bribery Langkat Regent Publishes Plan To Warn Angin Sentenced To 2.5 Years In Prison

JAKARTA - The panel of judges at the Corruption Court sentenced the Director of CV Nizhami Muara Warin Angin to 2.5 years in prison plus a fine of Rp. 200 million, subsidiary to 4 months in prison for being proven to have given Rp.

"The trial, stated that the defendant Muara Warin Angin was legally and convincingly proven guilty of committing a criminal act of corruption as the first alternative indictment. Sentencing the defendant with a prison sentence of 2 years and 6 months plus a fine of Rp. 200 million which if not paid was replaced with imprisonment for 4 months," said the chairman of the panel of judges Djumyanto at the Jakarta Corruption Court (Tipikor) as reported by Antara, Monday, June 20.

Muara was proven guilty based on the first indictment of Article 5 paragraph 1 letter b of Law No. 31 of 1999 as amended by Law No. 20 of 2001 on the Eradication of Corruption.

The verdict is the same as the demands of the KPK Public Prosecutor (JPU) who demanded Muara Warin Angin 2.5 years in prison plus a fine of Rp. 200 million, subsidiary to 4 months in prison.

"The aggravating thing is that the defendant's actions are against the efforts of the state or government in eradicating corruption. The mitigating thing is that the defendant has never been convicted, frankly and cooperatively during the trial, the defendant frankly admits his mistakes and regrets his actions," added judge Djumyanto.

In this case, the panel of judges assessed that Muara Warin Angin was proven to have bribed the inactive Langkat Regent to issue a Warin Angin Plan amounting to Rp.572 million related to the construction of a number of work packages at the Public Works and Spatial Planning Service (PUPR) and the Langkat District Education Office in 2021.

Terbit as the Regent of Langkat has trusted people, namely his brother who is also the Village Head of Raja Tengah Iskandar Warin Angin, Marcos Surya Abdi, Shuhanda Citra and Isfi Syahfitra. They are commonly called the "Kuala Group".

The Kuala Group has the task of lobbying by requesting a list of work packages for each agency in the Langkat district to be submitted to Iskandar. Furthermore, based on Iskandar's direction, a "commitment fee" was determined from each company for publication because the company had already received a work package.

The company appointed by the "Kuala Group" is obliged to provide a commitment fee of 16.5 percent of the total value of the work package to Terbit Plan Warin Angin.

Muara Warin Angin received a direct appointment work package at the PUPR Service, namely a hotmix work package worth IDR 2.867 billion; work packages for direct appointments, namely embankment rehabilitation, construction of fences and guard posts, construction of ring roads worth Rp971 million; as well as a direct appointment work package, namely the construction of SMPN 5 Stabat and SMP Hangtuah Stabat worth Rp.940.558 million.

However, on January 17, 2022, Muara met with Marcos and Isfi to ask for a reduction in the commitment fee to 15.5 percent and it was approved by Iskandar so that the total that Muara had to submit was Rp572,221,414 and rounded up to Rp572 million.

Muara handed over Rp572 million on January 18, 2022, which was wrapped in black plastic to Isfi Syahfitra. On the same day, Isfi and Shuanda handed over Rp572 million to Marcos to be given to Terbit Plan through Iskandar and they were secured by KPK officers along with evidence of money.
