Gunung Kidul Bawaslu Gives Debriefing Of Its Staff Regarding Election Criminal Articles
YOGYAKARTA - The Election Supervisory Body (Bawaslu) of Gunung Kidul Regency is reviewing the fulfillment of the elements of the election criminal article in welcoming the 2024 General Election (Pemilu).
The coordinator of the Gunung Kidul Bawaslu Violation Handling Division, Sudarmanto, explained that the activity was an effort to provide training to the Gunung Kidul Bawaslu staff regarding election crimes.
Sudarmanto hopes that through this activity, he can recall the provisions on the fulfillment of elements in the election criminal article. Because he said, the potential for criminal election violations could still occur in the implementation of future elections.
"We will carry out similar activities regularly in the future with different materials. This is to sharpen the study and application of article by article, including the study of supporting forms for handling violations," said Sudarmanto in Gunung Kidul, Yogyakarta Special Region (DIY), Tuesday 14 June.
He said the activities of the elements of the criminal article were part of a legal study in its application in a case-by-case manner in surgery by taking into account other provisions contained in the legislation related to the elements of the article being studied.
Meanwhile, the Coordinator of the DIY Bawaslu Violation Handling Division, Sri Rahayu Werdiningsih, said the principle of legality is a basic principle in criminal law that limits the validity of criminal law in terms of time.
The principle of legality implies that there is no prohibited act and is threatened with criminal if it is not determined in advance in the legislation, which in Latin is known as the adagium nullum delictum nulla poena sine praevia lege.
"This must be understood first when conducting legal studies in the election criminal article," he said.
