The Case Of Palm Oil Theft To Buy Children's Milk Has Been Stopped By Simalungun's Prosecution
MEDAN - The prosecution for the theft case was stopped by the Simalungun District Attorney (Kejari), North Sumatra. This step is related to restorative justice based on peace between the victim and the suspect.
The head of the Simalungun District Attorney's Office, Bobbi Sandri, explained that there were 8 charges that were dismissed related to the case of palm oil theft.
Bobbi explained that the eight suspects committed the theft of palm oil because of economic urgency. It was forced to do to meet the needs of the family because they do not have a permanent job.
"The eight suspects in Restorative Justice have different reasons. From buying milk for children, paying for children's schools and medical expenses for children, which are generally due to the pressure to live," explained Bobbi, Wednesday, March 23.
The termination of the prosecution of 8 cases of theft based on the approval of the Deputy Attorney General for General Crimes at the Attorney General's Office, Fadil Zumhana.
"With that, the Simalungun District Attorney's Office until March 2022 has terminated the prosecution of 8 cases through the restorative justice program," he said.
Bobbi said the reasons and considerations for terminating the prosecution with the application of restorative justice were guided by the Attorney General's Regulation No. 15 of 2020. That is, the suspect had committed a crime for the first time.
Then, the total loss due to theft does not exceed IDR 2.5 million and the penalty is under 5 years in prison. Furthermore, there was peace between the suspect and the victim and the community responded positively.
"The suspect and the victim have an amicable agreement. The suspect regrets his actions and promises not to repeat his actions again," said Bobbi.
