Jampidum Agrees To End Prosecution Of 2 Persecution Cases

JAKARTA - Head of the Attorney General's Office for Legal Information (Kapuspenkum) Ketut Sumedana explained that Deputy Attorney General for General Crimes (Jampidum) Fadil Zumhana approved two requests for termination of prosecution based on restorative justice involving cases of abuse.

"A peace process has been carried out in which the suspect has apologized and the victim has apologized. The peace process is carried out voluntarily, with deliberation for consensus, without pressure, coercion and intimidation," said Ketut Sumedana in a written statement quoted by Antara, Thursday, March 10.

There are also two case files whose prosecution was terminated based on restorative justice, namely the case files belonging to the suspect ABD. Rahman Bonto from the Pasangkayu District Attorney who is suspected of violating the First Primary Article 44 paragraph (1) subsidiary Article 44 paragraph (4) of Law Number 23 of 2004 concerning the Elimination of Domestic Violence or Second Article 351 of the Criminal Code.

The next case file is suspect Mairizal and suspect Rando Sony from the Tanah Datar District Attorney who are suspected of violating Article 351 paragraph (1) jo. 55 paragraph (1) of the Criminal Code concerning Persecution.

Another reason for giving the termination of prosecution is that the suspects have committed a crime for the first time, the punishment is not more than five years, and the suspect promises not to repeat his actions.

The suspect and the victim agreed not to continue the matter to trial because it would not bring greater benefits. In addition, Jampidum also considers the sociological existence.

"In the case of suspect ABD. Rahman Bonto, the suspect and the victim are a husband and wife couple and have 10 children," he said.

Furthermore, the Deputy Attorney General for General Crimes ordered the Heads of the District Attorney's Office to issue a Decision on Termination of Prosecution (SKP2) based on Restorative Justice, in accordance with the Attorney General's Regulation Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice and Circular Letter of the Deputy Attorney General for General Crimes Number 01 dated February 10, 2022 as the embodiment of legal certainty.
