Public Prosecutor Demands 3 Corruption Convicts In House Project DP Rp0 Appears 5-7 Years In Prison, Seizes Land In Bali Until Mini Cooper

JAKARTA - The Public Prosecutor of the Corruption Eradication Commission (KPK) has charged three defendants in the alleged corruption case in the land acquisition for the Rp0 DP residential project in Munjul, East Jakarta, with charges of 5.5 years and seven years in prison.

The three defendants are Director of PT Adonara Propertindo, Tommy Adrian and two beneficial owners of PT Adonara Propertindo, Anja Runtuwene and Rudy Hartono Iskandar. The case is considered to have cost the state Rp. 152.565 billion.

"Stating that defendant I Tommy Adrian, Defendant II Anja Runtuwene and Defendant III Rudy Hartono Iskandar have been legally and convincingly proven guilty of committing a criminal act of corruption jointly and continuously. Sentenced to defendant I Tommy Adrian to serve 7 years in prison, Defendant II Anja Runtuwene is 5 years and 6 months, while the defendant III Rudy Hartono Iskandar is sentenced to 7 years in prison," said KPK Public Prosecutor Ferdian Adinugroho at the Jakarta Corruption Court, Antara, Thursday, February 10.

The claim is based on the first indictment of Article 2 paragraph (1) of Law Jo. Article 18 No. 31 of 1999 as amended by Law no. 20 of 2001 concerning the Eradication of Corruption Crimes Jo. Article 55 paragraph (1) of the 1st Criminal Code Jo. Article 64 paragraph 1 of the Criminal Code. The KPK prosecutor also demanded the confiscation of the money that Anja Runtuwene and Rudy Hartono had returned amounting to Rp. 35,033 billion each and assets consisting of; a plot of land in Tibubeneng Village, North Kuta sub-district, Badung district, Bali province, covering an area of ​​5,150 square meters that has been auctioned for Rp. 22 billion; 2 parcels of land in Kuta Village, Kuta sub-district, Badung district, Bali covering an area of ​​690 square meters and 1,437 square meters with a total value of IDR 7 billion.

Prosecutors also asked for the confiscation of assets belonging to Rudy Hartono in the form of 1 unit of Mini Cooper S type Convertible A/T worth IDR 1.2 billion; 1 unit of black Honda motorcycle worth Rp. 56.878 million; a plot of land with an area of ​​6,625 square meters in Pancoran Mas, Depok, valued at Rp. 114.248 billion. There are a number of aggravating things in the actions of the three defendants.

"The defendants did not support the government's program to create a government free of collusion, corruption and nepotism; the defendants did not admit to some of the criminal acts committed; defendant I Anja Runtuwene and defendant III Rudy Hartono Iskandar each had the most significant role in the occurrence of the crime. corruption together," added prosecutor Ferdian.

The three defendants were also considered proven to be active actors in the implementation of corruption crimes.

"The defendants in carrying out their actions involved and took advantage of the roles of other actors. The value of the assets obtained by Anja Runtuwene and Defendant III Rudy Hartono from their criminal acts amounted to more than 50 percent of state/regional losses; the actions of the defendants resulted in provincial-scale losses," said the prosecutor. .

The KPK prosecutor also stated that the actions of the three defendants had caused Perumda Pembangunan Sarana Jaya (PPSJ) or the DKI Jakarta Provincial Government to not receive any benefit from the payments made for the purchase of land in Munjul, Cipayung, East Jakarta, resulting in state losses of more than Rp. 100 billion. .

"The mitigating thing is that the defendants have never been convicted; Defendant II Anja Runtuwene and Defendant III Rudy Hartono Iskandar voluntarily returned state/regional financial losses that they had obtained," added prosecutor Ferdi.

This case began in the 2018-2020 period, the DKI Jakarta provincial government looked for land for affordable housing for Low-Income Communities (MBR) through the "Owning DP 0 Rupiah" program.

To realize this program, in 2018 the President Director of BUMD Pembangunan Sarana Jaya Yoory Corneles submitted a proposal for Regional Capital Participation (PMD) to the Governor of DKI Jakarta for the 2019 FY APBD of Rp. 0 Rupiah", and the Tanah Abang Primary Center project.

Furthermore, a private company, namely PT Adonara Propertindo, is looking for land according to the criteria requested by Yoory, namely an area of ​​more than 2 hectares, position on a main road, a width of 25 meters in front of a plot of land and a minimum "row" of about 12 meters.

In February 2019, the operational manager of PT Adonara Anton Adisaputro discovered land in Munjul, Pondok Ranggon, Cipayung, East Jakarta, covering an area of ​​41,921 square meters belonging to the Congregation of the Sisters of Carolus Boromeus (Congregation of the Sisters of CB).

The "beneficial owners" of PT Adonara, namely Anja Runtuwene and Rudy Hartono Iskandar, agreed that Anja approached the Congregation of Sisters CB and agreed to sell the land in Pondok Ranggon with an area of ​​41,921 square meters at a price of IDR 2.5 million/sqm.

When a site survey was conducted, it was not possible to determine the boundaries of the land because there was no data or supporting documents for ownership and it was known that the location of the land was on a small road (the road row was not up to 12 meters long) but Yoory still ordered the purchase process to continue.

Yoory then used the services of the Public Appraisal Service Office (KJPP) Wahyono Adi to carry out the appraisal which was intentionally made "backdate" and submitted a report according to Yoory's request, which was Rp. 6.1 million/sqm.

On December 10, 2019, Sarana Jaya received a PMD disbursement of Rp. 350 billion and on December 18, 2019 it received a disbursement of PMD phase II of Rp. 450 billion so that the total PMD obtained was Rp. 800 billion.

Yoory knew that Munjul's land could not be used for the "residential DP 0 rupiah" project but still agreed to pay the remaining balance of Rp. 43,596 billion on December 18 and 19, 2019.

Because the deadline for repayment has ended in August 2019 but there has been no realization from Anja Runtuwene, on August 14, 2020, the Congregation of the CB Sisters requested that the Sale and Purchase Binding Agreement (PPJB) be canceled and requested that documents related to property rights be returned and refunded the money. advance of Rp. 10 billion.

The total money received in Anja Runtuwene's account amounted to Rp. 152,565,440,000 and has been used by Anja and Rudy Hartono, among others, for the operational needs of the company PT Adonara Propertindo, transferred to PT RHYS Auto Gallery which is still in the same group as PT Adonara as well as for Anja's personal needs.
