JAKARTA The Indonesian National Sports Committee (KONI) urges the Minister of Youth and Sports to revoke the Regulation of the Minister of Youth and Sports (Permenpora) Number 14 of 2024. The reason is that this regulation is very problematic.

Expert Staff for Central KONI Organization, Benny Riyanto, said that there are so many articles in this Permenpora that are not in line with umbrella rules. For this reason, normatively the regulation needs to be revised at least.

"So the Ministry of Youth and Sports should wisely and wisely revise or even need to revoke Permenpora Number 14 of 2024," said Benny after attending as a resource person at the National Seminar of the Indonesian Advocates Association, Official Kiss Nobile at the Grand Ballroom Hotel Pullman Central Park, West Jakarta, on Thursday, January 16, 2025.

Permenpora Number 14 of 2024 has caused pros and cons to date. In addition to violating the rules at the level of the law, this regulation is also considered to have left the Olympic Charter (Olympic Chapter).

Benny said that as a regulation that requires sports requirements, Permenpora should play a vital role in advancing the achievements of Indonesian athletes and not being counterproductive.

"There are many articles from the Permenpora that turn out to conflict with the umbrella regulations. This umbrella regulation is not even only in the rules of the law," he said.

The problems in the Permenpora are not only clashes with the rules, but also cut the independence and autonomy of the organization in national sports management.

Benny explained that it was the emergence of norms that were contrary to these ideologies that had to be addressed in accordance with the provisions in the attachment to the two laws Number 12 of 2011.

"There is also the potential if the government's good intentions are not awaited, earlier there were several sources who were ready to submit a judicial review to the Supreme Court," said Benny.

There are at least 10 conflicting norms in Permenpora Number 14 of 2024:

This is not in line with the principle of independence and is a form of intervention from the Government on the technical management of sports organizations.

This violates Law Number 11 of 2022 Paragraph (3) in conjunction with Government Regulation Number 46 of 2024 Article 73 Paragraph (3) and Olympic Charter, Basic Principles Fifth and Seventh, and Chapter 16 Verse 1.5.

This article contradicts Law number 11 of 2022 Article 79 Paragraph (1) and (2), as well as Regulation of the Minister of Finance number 219/PMK 05/2016 concerning Accounting and Financial Reporting Systems of Other Agencys.

KONI is given the right to obtain a budget from the APBN/APBD and has the obligation to make financial reports and predetermined accounting.

This is contrary to Law Number 11 of 2022 Article 79 Paragraph (1) and (2) and Regulation of the Minister of Finance Number 219/PMK 05/2016 as mentioned above.

The KONI budget is mostly from grants so that it becomes the object of government inspectorate examination. KONI is a Government Strategic Partner (at the KONI Strategic Partner Center level from the Ministry of Youth and Sports), while at the KONI Regional level it is a Strategic Partner of the Youth and Sports Service.

This is not in line with the principle of independence and is a form of intervention that violates Law Number 11 of 2022 Article 37 Paragraph (3) in conjunction with Government Regulation Number 46 of 2025 Article 73 Paragraph (3) and Olympic Charter, the Fifth and Seventh Basic Principles, and Chapter 16 Verse 1.5.

In addition, the principle of independence of sports organization administrators does not need to be made the normed criteria considering that the conditions of each sport vary widely.

This is the responsibility of the Government in accordance with the 1945 Constitution of the Republic of Indonesia Article 28 paragraph (1) c, Law Number 11 of 2022 Article 79 paragraph (1) and (2) in conjunction with Government Regulation Number 46 of 2024 Article 20 Letter g.

This is not in line with the principle of independence and is a form of intervention that violates Law Number 11 of 2022 Article 37 Paragraph (3) in conjunction with Government Regulation Number 46 of 2024 Article 73 Paragraph (3) and Olympic Charter, the Fifth and Seventh Basic Principles, and Chapter 16 Verse 1.5.

According to the Olympic charter, the management of sports organizations is independent and cannot be intervened by any party.

The management of the sports organization has been inaugurated by KONI because KONI was formed by the sport itself.

This is regulated in Law Number 11 of 2022 Article 37 Paragraph (1). In addition, it contradicts Law Number 11 of 2022 Article 37 Paragraph (3) which states, "Inducts for sports organizations and the National Sports Committee (KON) as referred to in Paragraph (1) are independent and professionally managed by administrators representing sports competence", in conjunction with Article 73 paragraph (3) of PP Number 46 of 2024, and Olympic Charter, the Fifth and Seventh Basic Principles, and Chapter 16 of Verse 1.5.

This is not in line with the principle of independence and is clearly a form of intervention that violates Law Number 11 of 2022 Article 37 paragraph (3) in conjunction with PP Number 46 of 2024 Article 73 paragraph (3) and Olympic Charter, the Fifth and Seventh Basic Principles, and Chapter 16 Verse 1.5, who know that organizational needs are members of the organization so that Article 21 Paragraph (2) is feared that other interests other than sports interests can enter.

This authority is the authority of KONI because KONI is the parent sport. Thus, the Ministry of Youth and Sports seems to be involved in sports coaching techniques.

This has an impact on reducing independence factors and sports organizations. Meanwhile, the authority of the Ministry should be as a regulator, not an operator.

Thus, the technical affairs of sports coaching are left to sports organizations (can the main organization for sports or KONI).

This is considered too excessive so that it violates the independence principles stipulated in Law Number 11 of 2022 Article 37 Paragraph (3) which states, "Inducts for sports organizations and the National Sports Committee (KON) as referred to in Paragraph (1) are independent and professionally managed by administrators representing sports competence", in conjunction with Article 73 Paragraph (3) of PP Number 46 of 2024, Olympic Charter, Fifth and Seventh Basic Principles, and Chapter 16 of Verse 1.5.
