JAKARTA - The Constitutional Court (MK) will suspend the trial of judicial review on Monday, 27 July. This was again done to sterilize the courtroom in preventing the spread of disease due to the corona virus.

"It has not been determined how long, we will see the progress," said Head of the Public Relations and Domestic Cooperation Section of the Constitutional Court, Fajar Laksono, as quoted by Antara, Thursday, July 23.

The Constitutional Court will carry out sterilization and spraying of disinfectant liquid to all rooms and work infrastructure in the institution building.

There is also a trial for a number of cases scheduled to be held on Monday 27 July, namely the judicial review of Law Number 17 of 2014 concerning the People's Consultative Assembly, the People's Representative Council, the Regional Representative Council and the Regional People's Representative Council proposed by Ignatius Supriyadi.

Furthermore, two judicial cases of Law 2 of 2020 concerning the Stipulation of Perpph No.1 of 2020 concerning State Financial Policy and Financial System Stability for Handling the Corona Virus Disease 2019 (COVID-19) Pandemic and / or in the Context of Facing Threats Endanger the National Economy and or Financial System Stability Becomes the Law proposed by Damai Hari Lubis and Triono and Suyanto.

Another case is the judicial review of Law Number 7 of 2017 concerning General Elections which proposed the Association for Elections and Democracy (Perludem). The entire trial was postponed until an undetermined time.

Online Hearing Options

Previously, the Constitutional Court canceled a trial for judicial review in mid-March 2020 and only held another trial at the end of April 2020. At that time, a number of parties submitted a judicial review of the Perppu on handling COVID-19 because it was considered urgent.

The Constitutional Court also had time to consider holding an online trial, so that the judicial review applicant did not have to attend the trial. However, this option is still being discussed regarding the most likely testing mechanism in accordance with the procedural law.

However, according to the results of the judges' deliberation (RPH) at that time, decided to temporarily suspend a number of trial agendas as an effort to prevent and minimize the spread of the Corona virus or COVID-19. The policy was outlined and stipulated in the Circular (SE) of the Secretary General of the Constitutional Court concerning Efforts to Prevent the Spread of COVID-19 in the Constitutional Court, March 16, 2020.

Regarding work system management, in principle, all employees of the Constitutional Court are instructed to carry out their main duties and official functions by working from and at home, except for certain employees / officers who are appointed to remain in the office according to the needs of each work unit.
