Attorney General Reminds Staff To Apply Law With Conscience

JAKARTA - Attorney General Sanitiar Burhanuddin reminded the prosecutors to apply the law based on conscience.

According to Burhanuddin, there has been a paradigm shift from retributive justice to restorative justice. This is a challenge for prosecutors to change their perspective as law enforcement officers.

"Conscience must be the basis for consideration of every prosecutor's employee in carrying out their duties and authorities as well as in making decisions and this is my special concern," said Burhanuddin, quoted by Antara, Wednesday, September 1.

Burhanuddin wants the prosecutors to realize true legal justice and be more humane before the law. There should be no more cases where it seems that law enforcement officers have the heart to punish small people and the elderly for their mistakes which are considered not too serious.

"So the application of the law based on conscience is a necessity in the Indonesian criminal justice system," he said.

The Prosecutor's Office has issued RI Prosecutor's Regulation Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice as a form of crystallization of the application of law based on Conscience.

In addition, two of the seven 2021 Attorney General's Daily Orders delivered on the 61st Day of Bhakti Adhyaksa serve as a reminder to all prosecutors' employees, namely "Use conscience in every execution of duties and authorities, as well as an order to "Maintain the dignity of the institution by working diligently". intelligent, integrity, professional and conscientious".

"The Prosecutor's Office is a man of law. Officials who understand and understand how the law is applied. I believe that if we are careful in reading the formal and material details and consistently use conscience as a basis for consideration in every prosecution process, the Prosecutor's Office will be able to present legal justice that brings benefits and at the same time legal certainty for all parties," said Burhanuddin.

In his presentation, the Attorney General also conveyed the results of the evaluation since the implementation of restorative justice on July 22, 2020 until June 1, 2021, based on reports received by the Attorney General of the Republic of Indonesia, there were 268 cases that were successfully terminated based on restorative justice.

There are also crimes that are mostly resolved with a restorative justice approach are crimes of persecution, theft, and traffic.

"This data should shock the prosecutor because it turns out that so far there have been many seekers of justice and many cases such as Grandma Minah and Grandpa Samirin that were not exposed by the media have received inappropriate legal treatment and should not be forwarded to court," said Burhanuddin.
