MAKI's Plan To Sue Puan Maharani In The Administrative Court Recovers Polemic, Boyamin Saiman Doesn't Care And Gets More Enthusiastic!

JAKARTA - The Indonesian Anti-Corruption Society (MAKI) plans to sue Puan Maharani regarding the issuance of the Letter of the Chairman of the House of Representatives of the Republic of Indonesia Number PW/09428/DPR RI/VII/2021 dated July 15, 2021, to the leadership of the DPD RI. This letter contains the submission of 16 names of candidates for members of the BPK RI.

Two of the total names of candidates proposed, namely Nyoman Adhi Suryadnyana and Harry Z. Soeratin, allegedly did not meet the requirements.

MAKI Coordinator Boyamin Saiman stated that he was confident in the lawsuit that would be filed with the Administrative Court.

"I am very confident and plan to (submit a lawsuit to the Administrative Court) tomorrow, Tuesday, August 10 tomorrow," Boyamin said in Jakarta as reported by Antara, Monday, August 9.

The requirements as referred to in Article 13 Letter j of Law Number 15 of 2006 concerning the Supreme Audit Agency which states that prospective members of the BPK must have at least 2 years left their position as an official in the management of state finances.

The evidence in the form of a letter from the chairman of the DPR RI is believed by Boyamin to be submitted to the State Administrative Court (PTUN) even though it was questioned.

"Many expert opinions also say that even if it is in the form of a letter, the format of the official note can be sued in the Administrative Court," he said.

Regarding the legal standing, he said that MAKI together with the Indonesian Law Enforcement Supervision and Oversight Institute (LP3HI) which also filed a lawsuit met the requirements because they had a deed of establishment and a Registered Certificate (SKT).

Boyamin said that he was a citizen who suffered losses if the elected BPK members later did not meet the requirements.

Boyamin said that the polemic that arose after the proposed lawsuit actually made him excited and grateful because this issue would continue to be a public concern.

"I am grateful that this lawsuit has become a public discussion and public attention that currently there is a selection of BPK members being carried out by the DPR," said Boyamin.

Previously, a number of parties questioned Boyamin's plan to sue the Speaker of the DPR RI, Puan Maharani, because two of the 16 candidates for BPK did not meet the requirements.

One of them came from legal observer Irfan Fahmi who assessed that the letter from the Chairman of the DPR as the basis for a lawsuit could not become an object of state administration (TUN).

"The DPR's letter cannot be the object of a TUN dispute because it is not final and binding and has not yet caused individual legal consequences," said Irfan, last Friday.

So who are Nyoman Adhi Suryadnyana and Harry Z Soeratin? From 3 October 2017 to 20 December 2019, Nyoman Adhi served as Head of the Manado Customs and Excise Supervision and Service Office (head of echelon III satker). With this position, it means that Nyoman Adhi is the manager of state finances or the power user of the budget/KPA.

Meanwhile, Harry Z Soeratin was inaugurated by the Minister of Finance in July 2020 as Secretary of the Directorate General of Fiscal Balance (DJPK), which is also the position of KPA, in the sense that he still holds the position of KPA.
