JAKARTA - Police officers named the artist Dinar Candy as a suspect and charged him with the Pornography Law No. 44/2008 with a prison term of 10 years and a fine of IDR 5 billion. This decision has become a hot topic of discussion in the public.

Looking at the Pornography Law that ensnared Dinar Candi, telematics expert Roy Suryo spoke again. As a person who has been a resource person for making the Pornography Law, when he was a member of the council, Roy explained the differences in places or spaces of expression based on the applicable law.

“The pornography law cannot be put in place, for example there is an exhibition of a statue in a bikini, then in an exhibition there is a statue without clothes, it cannot be applied. Because the exhibition uses a special room for exhibitions. For example, in a photo exhibition, there is a model who wears minimal clothing, but if the place is at an exhibition, a studio or at the beach, she is correct.” explained Roy Suryo to VOI, Friday, August 6.

To differentiate Roy, giving an example, if there is an exhibition on the side of the road, then public law applies.

“Many artists also like to be strange outside of space, this is the problem whether the space has a limit or not. For example, at a crossroads, it's nice to have an exhibition on the side of the road. If the roadside expression that applies is the outdoor public law." Roy explained.

However, Roy said, it would be different if the exhibition showed an unusual image or display in public or public, such as showing body parts.

“So if there (exhibition, ed) more lay people (not related to the exhibition) who accidentally pass by, and can see, it means open space. Not an enclosed space. There must be a limit where is the public space and where is the private space.” Roy explained.

Like Dinar Candy, Roy believes that if the action is carried out on the beach or in the hotel swimming pool, then it will be a different matter. In short, if Dinar Candy is wearing a bikini on the beach, then there is no problem, because the law of closed space is used, which is specifically reserved.

“For example, Dinar Candi wearing a bikini on the beach, maybe we can say that he is free from the Pornography Law. Because on the beach people are free to wear any clothes because it is according to their designation. Like an exhibition, you have to come to the art building to see the exhibition. But if this time it is on the side of the road, many passersby who are not interested in watching it, that is what is called a public space.” he explained.

Roy Suryo also hopes that the public must understand the limits, because there are laws that apply and have been regulated by the state.

“Well, he (Dinar Candy) must know that it is a public space. There are people passing by in public spaces, where people don't intend to watch it. Well, if so, what applies is the law of public space, not the law of closed spaces. It's different in tourist attractions such as the beach, where wearing a bikini is indeed the place. said Roy.
