Fleeing From 1-year Sentence And Fined IDR 500 Million, Convict Smuggler Of 1.500 Nokia Cellphones Made A Death Certificate

JAKARTA - The District Attorney's Office (Kejari) of Bengkayang, West Kalimantan arrested Jutin Lais (66), a man from Jagoi Babang, who was convicted of smuggling thousands of mobile phones in 2008. Jutin Lais was informed that he had died.

The Head of the Bengkayang Prosecutor's Office, Fachrizal, said that the convict was arrested on Monday, August 2, at around 13.30 p.m. local time. The arrests were made after the Attorney General's Office received a copy of the Supreme Court's cassation decision.

The Bengkayang Kejari execution team then moved to find the convict. "However, the whereabouts of the convicts are difficult to find", explained Fachrizal in a written statement in Bengkayang, quoted by Antara, Tuesday,

Jutin Lais (66) is a resident of Jagoi Babang who was found guilty based on the Decision of the Supreme Court of the Republic of Indonesia No. 2060 K/Pid.Sus/2009, dated September 29, 2010. This decision confirms the decision of the Bengkayang District Court and the Pontianak High Court, which is 1-year imprisonment. 3 months and a fine of IDR 500 million.

However, it turned out that the convict had reportedly died and received a death certificate from the Jagoi Babang village head. This was known in 2016, when the Bengkayang District Attorney asked the Bengkayang Police for assistance in finding the convict Jutin Lais in order to carry out the execution of the Indonesian Supreme Court's decision.

However, not long after, the Bengkayang District Attorney received a letter stating that the convict had died on the basis of the issuance of a death certificate from the Jagoi Babang Village Head.

"But we have information that the convict is still alive and in the Bengkayang Regency", he said.

Currently, the convict is taken to the Bengkayang Kejari Office for the administrative process of carrying out the execution, then before going to the Bengkayang Court to undergo the sentencing process.

Meanwhile, the Head of Special Operations Unit, Adityo Utomo, said that the Jutin Lais case in 2008, namely a criminal case against the Customs Law, namely the smuggling of 1.500 units of Nokia type 1200 mobile phones, 20 units of Nokia type 2600 mobile phones, and 40 bottles of printer ink from Malaysia.

In the decision of the Bengkayang District Court No.67/Pid.B/2008/PN.BKY dated September 17, 2008, the convict Jutin Lais was found guilty of violating Article 102 of Law Number: 17 of 2006 concerning Amendments to Law Number 10 of 1995 concerning Customs and in imprisonment for 1 year and 3 months and a fine of IDR 500 million.

The convict had made legal efforts to the level of cassation, but in the decision of the Supreme Court of the Republic of Indonesia No. 2060 K/Pid.Sus/2009, dated September 29, 2010, rejected the appeal of the defendant, and the Public Prosecutor's Office of Bengkayang and upheld the decisions of the judges of the Pontianak High Court and the Bengkayang District Court.
