Application Granted, Indictment Session Of Muara Enim Regent Off Juarsah Postponed

JAKARTA - The inaugural trial of the defendant Muara Enim Regent, Juarsah, has been postponed until next week. Originally, the trial this time was the reading of the indictment from the KPK prosecutor.

The postponement of this trial was approved by the Palembang Court of Justice, chaired by Sahlan Effendi. The panel of judges approved the request for transfer of detention submitted by Juarsah, a defendant in the alleged bribery case of 16 project packages at the PUPR Office of Muara Enim Regency in 2019.

The application was submitted because Juarsah is currently still in detention status at the KPK detention house, for that she humbly requests that she be transferred to the Palembang state detention house (Rutan).

The KPK Public Prosecutor Team (JPU) Agung Satrio said that Juarsah's application had been fully submitted to the panel of judges as long as the current pandemic conditions were considered.

"We, the public prosecutor's team, have coordinated with Juarsah's legal team, for the mechanism for the two requests, the team will discuss the results first and the results will be notified to their attorneys as soon as possible," Agung said as quoted by Antara, Thursday, July 1.

Meanwhile, the defendant's attorney, Saipudin Zahri, said that his party had difficulty accessing the KPK building in Jakarta even though it was only to request a signature for the appointment of the power of attorney to accompany Juarsah during the trial.

"Earlier, the panel of judges facilitated direct coordination with the KPK prosecutors, but the answer is that the power of attorney can be deposited, obviously we don't want to," said the former Adhoc Tipikor judge.

According to him, legally it cannot be done, because the power of attorney is a black and white document that must be signed directly by the person concerned, in this case Juarsah is known directly by the appointed attorney.

"We are waiting for the KPK prosecutor's decision so that we are allowed to directly submit the power of attorney to be signed as well as accompanying suspect Juarsah in the process of transitioning the suspect's detention status from Jakarta to the Palembang detention center," he said.

Juarsah was named a suspect by the KPK after the development of the Hand Capture Operation in September 2018 with five other suspects, namely Ahmad Yani as Muara Enim Regent for the 2018-2019 period.

Then Elfin MZ Muchtar, Head of Development and PPK of the Muara Enim PUPR Service, Robby Okta Fahlevi as the private contractor for bribery, Arie HB, the former chairman of the Muara Enim DPRD, and Ramlan Suryadi as the former Plt of the Muara Enim PUPR Service.

The five suspects have become convicts because they have been tried and decided at the Palembang Tipikor District Court with a guilty verdict and have permanent legal force (inkrach).

Defendant Juarsah as the indictment that was handed over was charged with violating Article 12 a or Article 11 and or Article 12 B of the Republic of Indonesia Law Number 31 1999 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph 1 1 of the Criminal Code, in conjunction with Article 64 paragraph 1 of the Criminal Code .
