Rizieq Shihab's Total Sentence Is 4 Years 10 Months In Prison For Cases Of Crowds And COVID-19 Swab Hoaxes

JAKARTA - The former High Priest of the FPI, Rizieq Shihab was cumulatively sentenced to 4 years and 10 months in prison and a fine of Rp. 20 million. The verdict is the cumulative total of three cases of crowd and health protocol violations (prokes).

"Yes, in total, Habib Rizieq's sanction is 4 years and 10 months and a fine of Rp. 20 million," Rizieq's lawyer, Sugito Atmo Prawiro, told VOI, Thursday, June 24.

According to Sugito, all the sentences in the verdict given to his client were indeed unified because the locus delicti of each case was different. So Rizieq must undergo all the sanctions given.

"All the verdicts from the panel of judges are cumulative. But even if we don't appeal, this is in all cases we appeal," he said.

Rizieq Shihab in the case of crowd violations and health procedures in Petamburan was declared legally and convincingly violating Article 93 of Law Number 6 of 2018 concerning Health Quarantine.

The panel of judges also sentenced Rizieq to 8 months in prison. Although, the verdict was lower than the prosecutor's request for 2 years.

Meanwhile, for the crowd and prokes violation cases, Rizieq was found guilty of violating Article 93 of Law Number 6 of 2018 concerning Health Quarantine, which is more specific for everyone who is obliged to comply with the implementation of health quarantine.

In this case, Rizieq was only sentenced to a fine of Rp. 20 million. This verdict is also lower than the prosecutor's demands, namely, 10 months in prison and a fine of Rp. 50 million.

Finally, the case of the results of the UMMI Hospital swab. In this case, Rizieq Shihab was sentenced to 4 years in prison because he was found guilty of violating Article 14 paragraph (1) of the Republic of Indonesia Law Number 1 of 1946 concerning the Criminal Law Regulations Jo Article 55 paragraph (1) of the 1st Criminal Code.
