Denies Cannot Answer Who Is The Initiator Of TWK, Nurul Ghufron: Komnas HAM's Statement Is Not True!

JAKARTA - Deputy Chairman of the Corruption Eradication Commission (KPK) Nurul Ghufron denied the statement by the Commissioner for Monitoring and Investigation of Komnas HAM Choirul Anam, who said he could not answer questions when asked for information.

Including, who is the initiator of the National Insight Test Assessment (TWK) which is a condition for transferring the status of an anti-corruption commission employee.

"I need to clarify that the statement by Komnas HAM Commissioner Choirul Anam is not true, who said I don't know who initiated the TWK idea," Ghufron told reporters, Friday, June 18.

He admitted that he had given an explanation regarding TWK to Komnas HAM on Thursday, June 17 yesterday. Ghufron said that he explained that the discourse on this test began during a meeting between the KPK and a number of related parties on October 9, 2020.

At that time, he said, it was discussed about fulfilling the conditions for loyalty to Pancasila, the Unitary State of the Republic of Indonesia, the 1945 Constitution and the legitimate government, whether it was enough to sign an integrity pact or not.

"From the discussion, it continued to develop and agreed to refer to the applicable regulations, namely to become an ASN there is a Basic Competency Test and a Field Competency Test," he said.

The basic competency test includes three aspects, namely the general intelligence test (TIU), the personal characteristics test (TKP), and the national insight test (TWK).

"This was then agreed upon in the draft KPK Perkom draft on January 21, 2021 which was submitted to the Ministry of Law and Human Rights for harmonization. Furthermore, the draft was agreed upon and signed in full by the KPK leadership after it was closed with all KPK structures," he explained.

Furthermore, Ghufron said that KPK employees did not undergo TIU, including the competency test, because they had already been tested when they were about to enter as permanent or non-permanent employees. So, it was decided that employees only run TWK as a measuring tool for fulfilling the requirements as ASN.

He also claimed that the TWK implementation was in accordance with applicable regulations, namely Government Regulation (PP) No. 41 of 2020 and Perkom No. 1 of 2021.

"The requirements in PP 41 of 2020 are the same as the requirements to become an ASN in Law 5 of 2014 concerning ASN articles 3, 4, 5 and 66. Besides the ASN Law, article 62 paragraph (2) and, also mandated in PP 11 of 2017 article 26 paragraph (4) regarding TWK," he said.

Previously reported, the National Human Rights Commission (Komnas HAM) said that there were a number of questions that could not be answered by the Deputy Chairperson of the Corruption Eradication Commission (KPK) Nurul Ghufron regarding the implementation of the National Insight Test Assessment (TWK). This test is a requirement of the transfer of employee status to State Civil Apparatus (ASN).

This was conveyed by the Commissioner for Monitoring and Investigation of the National Human Rights Commission, Mohammad Choirul Anam, after asking for information from Ghufron, which started at 10.30 WIB until around 15.00 WIB.

According to him, Ghufron who came as a representative of the KPK leadership could not answer about the procedure for implementing TWK, including why he chose TWK as one of the conditions.

"Why is it that the national interview test that was explained earlier by Pak Nurul Ghufron and Pak Nurul Ghufron also cannot answer because the KPK does not know that it is a line from the BKN (State Civil Service Agency)," Anam told reporters at his office, Jalan Latuharhary, Jakarta. At least, there are three clusters of questions that Ghufron said that Anam could not answer. First, regarding policy making at the level of whether it is a joint decision with the KPK leadership or not.

"That's why it must be (answered, ed) those people who were involved in the construction of the incident," he said.

Next, Ghufron is also said to be unable to answer the questions that characterize the process. Finally, the Deputy Chairperson of the KPK also could not answer who first came up with the idea of using TWK in the transfer of employee status.

"Because he wasn't the one (who put out the idea, ed) and he couldn't answer either," said Anam.
