JAKARTA - The Center for Budget Analysis (CBA) assesses that the appearance of the name of the Member of the Financial Audit Agency (BPK) Nyoman Adhi Suryadnyana in the alleged import bribery hearing in the Directorate General of Customs and Excise should be a moment to strengthen the transparency and accountability of state institutions.

This was conveyed by CBA Executive Director Uchok Sky Khadafi who said that the emergence of Nyoman's name should not be seen as an attack on the BPK. On the contrary, openness is needed to maintain public trust.

"The more open an institution is in explaining the problems that arise, the stronger the public's trust in the institution," said Uchok in his statement, Thursday, June 25.

Uchok emphasized that BPK as an institution with a constitutional mandate to examine the management of state finances is at stake after the appearance of Nyoman's name in the trial.

During the customs trial, it was revealed that Blueray Cargo Director, John Field, and former Director of Customs Enforcement and Investigation Rizal knew each other through Nyoman Adhi. However, Uchok reminded that this fact is still part of the process of proving in court.

"From the beginning we emphasized that the appearance of a person's name in a trial does not automatically mean criminal involvement. The presumption of innocence must still be respected," he said.

However, Uchok considered that the fact of the trial was worthy of the attention of law enforcement officials, including the Corruption Eradication Commission (KPK), considering that Nyoman had a long track record in the Directorate General of Customs and Excise before serving as a member of the BPK.

"This issue does not stop at the existence or non-existence of a criminal offense. What is at stake is even greater, namely public confidence in the state financial examination institution," he said.

Uchok said that the BPK as an institution regulated in Article 23E of the 1945 Constitution has a constitutional function to examine the management and financial responsibilities of the state. In addition, Law Number 15 of 2006 also mandates the BPK to conduct financial audits, performance audits, audits with specific objectives, provide recommendations, and monitor the follow-up results of the audit.

With this authority, according to him, members of the BPK are required to maintain ethical standards and independence in carrying out their duties.

In addition, CBA also asked the Blueray Cargo case to be used as a national evaluation material for the import supervision system and the optimization of state revenue. Uchok assessed that the results of the audit related to the customs sector needed to be followed up seriously by all stakeholders to strengthen the supervision system and prevent similar problems from recurring in the future.

"Someone may not have violated criminal law, but still raises serious questions regarding independence, objectivity, and potential conflicts of interest. Therefore, transparency is very important to maintain the dignity and credibility of the institution," concluded Uchok.
