JAKARTA - The boss of PT Blueray Cargo, John Field and the defendants in the alleged import bribery in the Customs Directorate General asked the Jakarta Corruption Court to consider the cooperative attitude that has been shown during the trial process.
This request was conveyed in the defense or closing statement read by the legal advisory team at the Central Jakarta Corruption Court. The defendants are said to have never fled, eliminated evidence or influenced witnesses during the investigation process until the trial took place.
"The defendants chose to be honest because they hope that this case can be a momentum to improve the system and end the practices that have burdened the business world," said Legal Advisor for PT Blueray Cargo, Dinalara Dermawati Butar-butar in a closing statement quoted on Monday, June 15.
The legal advisory team also highlighted the facts revealed during the trial. The matter, which is now rolling in court, is part of a wider series of events and involves a number of other parties mentioned in witness statements and evidence submitted.
However, not all parties mentioned in the series of events were processed in the same case.
"We convey this for the sake of upholding the principle of equality before the law so that all parties suspected of being involved receive the same legal treatment," said Dinlara.
In addition to asking for equality in law enforcement, the defense team also asked the panel of judges to consider the background of the case.
During the trial, for example, it was revealed that Blueray Cargo faced a high level of targeting and channeling compared to other companies operating in the same sector.
According to Dinalara, this condition has a direct impact on the company's operations and is an important part that needs to be considered in looking at the whole case.
"Instead of getting ease, Blueray Cargo still faces various obstacles and pressures that ultimately bring the company to a very worrying condition," he said.
The lawyer also highlighted the social impact that emerged after the case was rolled over. Blueray Cargo, which previously employed around 1,300 workers, now only has around 200 people left.
Most employees are said to have been laid off and only tasked with completing the company's obligations that are still running.
"Behind these numbers are thousands of families who have lost their livelihoods, lost their children's education costs, and lost hope for their future," concluded Dinalara.
Especially for the defendants Andry and Dedy Kurniawan Sukolo, the defense team asked the judge to give a different and proportional assessment compared to John Field. Because the two of them only worked at the company.
Andry and Dedy are said not to be the owners of the company, not shareholders, not policy makers and do not receive economic benefits from the grant that is the subject of the case.
"They are just workers who receive salaries like other employees. They do not enjoy the results, do not enrich themselves, and their involvement is born solely because of the employment relationship," he said.
Closing the defense, the legal advisory team stated that the defendants did not come before the law with denial, but with honesty and a cooperative attitude.
Therefore, they asked the panel of judges to impose a verdict that not only considers legal aspects, but also justice and human values.
