Two Kacab Bank Defendants Sentenced to Pay Restitution of Rp500 Million to Rp750 Million

Two defendants in the alleged kidnapping and murder of a bank branch head with the initials MIP (37) were sentenced to pay compensation (restitution) to the victim's family worth Rp500-750 million.

"Punish the defendant one and the defendant two to pay restitution to the family of the deceased MIP as read," said Chief Judge Colonel Chk Fredy Ferdian Isnartanto in the reading of the verdict at the Military Court II-08 Jakarta, East Jakarta, Wednesday, June 3, reported by ANTARA.

The first defendant, Serka Mochamad Nasir, was given an additional penalty in the form of paying restitution in the amount of IDR 750 million no later than 30 days after receiving the decision which has become legally binding.

Meanwhile, the two defendants, Kopda Feri Herianto, were given an additional penalty in the form of paying restitution of IDR 500 million at the latest 30 days after receiving the decision which has become legally binding.

If defendants one and two have not yet carried out the restitution, the Military Audit ordered defendant one to carry out the restitution no later than 14 days after receiving the order.

If this is not carried out, the defendant's wealth can be confiscated and auctioned to meet the payment of restitution within 30 days.

For the first defendant, if in terms of wealth is not enough for restitution, then he will be sentenced to seven months in prison taking into account the restitution that has been paid proportionally. Meanwhile, the second defendant was sentenced to five months.

In the decision, the panel of judges stated that the defendant, Serka Mochamad Nasir, was sentenced to 13 years in prison after being proven legally and convincingly guilty of committing a crime in the subsider indictment "murder in common".

Then, the defendant, two Kopda Feri Herianto, was sentenced to seven years in prison after being proven legally and convincingly guilty of the crime of "seizing someone's independence resulting in death, which was carried out together".

Meanwhile, the third defendant, Serka Frengky Yaru, was sentenced to one year in prison after being proven legally and convincingly guilty of the crime of "seizing someone's independence resulting in death, which was carried out together".

"Accused one and two were given additional sentences of dismissal from military service," said Fredy.

Previously, the defendant was ordered to pay compensation (restitution) to the victim's family worth Rp. 5.8 billion as LPSK had conducted an in-depth examination of information and assessment of the amount of loss suffered by the victim or his heirs for the criminal incident experienced.

The restitution application was filed by the victim's wife, Puspita Aulia, as the victim's heir. In a letter dated May 13, 2026, LPSK said it had conducted an investigation, deepened information, and calculated the losses suffered by the victim and his family.
