Mahfud MD Confirms BLBI Naughty Obligors And Debtors Can Be Brought To Criminal Law

JAKARTA - Coordinating Minister for Political, Legal and Security Affairs (Menko Polhukam) Mahfud MD asked obligors and debtors in Bank Indonesia Liquidity Assistance (BLBI) to cooperate when billed by the government's BLBI Task Force.

Because, those who are naughty or run away from responsibility are very likely to be dragged into the realm of criminal law.

"If there is disobedience, even though it is civil. To remember, if you intentionally violate your civil debt, you may end up turning into a criminal act," Mahfud said in a press conference broadcast at the Indonesian Coordinating Ministry for Political, Legal and Security Affairs, Friday, June 4.

The former Chief Justice of the Constitutional Court (MK) said that the possibility of criminal prosecution could occur when BLBI obligors and debtors refused to admit their debts and even provided false evidence regarding repayment. Because, it can harm the state and violate the law.

"So it could turn into corruption later, the law," said Mahfud.

Furthermore, he said the implementation of this criminal law would later be supported by existing law enforcers such as the KPK, the Attorney General's Office, and the Criminal Investigation Unit of the Police. Not only that, the state can also cooperate with the international community in accordance with the United Nations Convention Against Corruption (UNCAC) agreement.

Therefore, Mahfud asked all obligors and debtors to cooperate even if necessary to be proactive. This is because they cannot hide because the BLBI Task Force already has a list of those who have not completed their responsibilities.

"So we know you know. So there is no need to open up to each other, let's just cooperate. We will work, this is for the country and you must also work for the country," he said.

As previously reported, the government has formed a Task Force for Handling State Collection Rights for the Bank Indonesia Liquidity Assistance Fund or the BLBI Task Force.

This task force was formed through Presidential Decree of the Republic of Indonesia (Kepres) Number 6 of 2021 concerning the Task Force for Handling State Collection Rights for BLBI Funds on April 6, 2021.

The establishment of a task force which is under and responsible to the President is aimed at handling, resolving, and restoring state rights originating from BLBI funds effectively and efficiently.

Then, in the form of legal remedies and/or other efforts at home or abroad, both against debtors, obligors, company owners and their heirs as well as other parties who cooperate with them, as well as recommending policy treatment for the handling of BLBI funds.

"In carrying out its duties, the Task Force for Handling State Collection Rights for BLBI Funds may involve and/or coordinate with ministries/non-ministerial government agencies, central and regional government agencies, the private sector, as well as other parties deemed necessary," stated the provisions in the regulation on the BLBI Task Force. .
