NTB Prosecutor's Office has not completed the MXGP Circuit Land Corruption File in Samota

JAKARTA - The West Nusa Tenggara High Prosecutor's Office (Kejati NTB) is still completing the series of seizures from the corruption case for the procurement of land for the construction of the MXGP Circuit in the Samota area, Sumbawa.

"That (the matter of land procurement for the Samota MXGP) is again a clearing. Let's immediately distribute it, go to court. If there is another expert examination and what not, yes, we will hurry (tuntas)," said Head of the NTB High Prosecutor (Kajati) Wahyudi in Mataram, Monday.

Regarding the existence of three investigation files that emerged in the 2022-2023 land procurement corruption case, he emphasized that the position of the file that will soon be brought to trial is related to the main case which has named three people as suspects.

"Yes, there are three sprindik (investigation orders), but who wants to enter this (court), for the main case first, other sprindik, it will still be developed," he said.

NTB Prosecutor's Spokesperson Harun Al Rasyid previously said that he was new in this case related to alleged money laundering (TPPU) and gratification.

He explained that the sprindik regarding TPPU was related to Subhan's position, the suspect in the main case of land procurement, as Head of the BPN Sumbawa Office for the period 2022-2023 and Head of the BPN Lombok Tengah Office for the period 2023-2025.

Likewise, the time of imprisonment from the alleged gratification in two positions of Subhan as head of the BPN, the period 2022-2023 while serving in Sumbawa and 2023-2025 in Central Lombok Regency.

In the last progress of the handling, the NTB Regional Attorney's Office Special Criminal Investigation Team searched Subhan's house which is located in Karang Bongkot Village, Labuapi District, West Lombok Regency.

The search, which is part of the investigators' efforts to strengthen the criminal evidence, was carried out based on the tracking of assets and the results of data collection from the Financial Transaction Analysis Reporting Center (PPATK).

In the main case, the prosecutor's office named Subhan as a suspect who played a role as the head of land procurement while holding the position of Head of the Sumbawa BPN Office, along with Muhammad Julkarnaen as a team of assessors from the private sector who came from the Public Appraisal Service Office (KJPP).

The third suspect appeared on Thursday (29/1), the NTB Prosecutor's Office named Saipullah Zulkarnain, a colleague leader from KJPP who carried out an appraisal of the acquisition of the Samota MXGP land in 2022-2023.

In the determination, the prosecutor applied the presumption of criminal liability in accordance with the new Criminal Code regarding corruption, namely Article 603 and/or Article 604 in conjunction with Article 20 letter c of Law Number 1 of 2023 concerning the Criminal Code.

At the stage of investigation of the main case, the prosecutor's office also recorded that it had received the deposit of money to compensate for state financial losses from the seller of the land, the former Regent of East Lombok Ali Bin Dachlan, worth Rp6.7 billion according to the results of the NTB BPKP auditor from the purchase value of Rp52 billion for land with an area of 70 hectares.
