JAKARTA - Dozens of employees who have not passed the National Insight Test Assessment (TWK) and are disabled, including Novel Baswedan, continue to fight back.
Most recently, they registered a judicial review lawsuit with the Constitutional Court (MK) and have prepared dozens of evidence.
"We'll list it first, then there will be 28 evidence that will be submitted to the Constitutional Court," said one of the representatives of 75 disabled KPK employees, Hotman Tambunan to reporters at the Constitutional Court (MK) Building, Wednesday, June 2.
He said this step was taken to examine a number of articles and interpretations in the TWK implementation process as a condition for the transfer of employment status. This includes measuring loyalty to Pancasila, the 1945 Constitution, the Unitary State of the Republic of Indonesia, and Bhinneka Tunggal Ika.
"We see that BKN is kind of monopolizing that understanding by using the TWK measuring instrument. Well, whether the measuring instrument is valid and so on, we'll see. We'll open it at the Constitutional Court trial," said Hotman.
Furthermore, this lawsuit was also filed to find out about nationality which is now considered to have tripped dozens of KPK employees.
"What is meant by nationality is good speech but violates the code of ethics or people who struggle to eradicate corruption, people who comply with the rules, and people who pay taxes? Then we'll see at the Constitutional Court trial," he said.
Previously reported, as many as 75 KPK employees, including senior investigator Novel Baswedan and Chairman of the KPK Employee Forum Yudi Purnomo, were declared not to have passed the TWK. Of these, 51 employees will be fired because they are considered uneducated after receiving red points from assessors.
Meanwhile, 24 of them can still be fostered with education in defending the country and national insight although if they do not pass, they can also be fired.
The TWK implementation process also received attention because of many irregularities. One of them, the questions asked in the interview session between employees and assessors are considered to touch the private sphere.
In their resistance, dozens of these employees have reported alleged violations in the TWK process to various parties. This includes reporting allegations of human rights violations to Komnas HAM and the ongoing investigation.
