Residents Question Plans For Land Control At The Kebon Nanas TPU, East Jakarta

JAKARTA - A number of residents of Cipinang Besar Selatan, Jatinegara, East Jakarta, questioned the plan of the DKI Jakarta Provincial Government to control residents' houses on the land of the Kebon Nanas Public Cemetery (TPU).

"Asking about this step is because a number of residents claim to have legality on land used to build houses," said Secretary of RW 05 Cipinang Besar Selatan, Muhammad Yusuf when confirmed in Jakarta, Sunday.

This follows the plan of the DKI Jakarta Provincial Government (Pemprov) to curb the settlements of the Kebon Nanas TPU residents and the Rawa Bunga Governor and return them according to their function to become burial grounds.

According to Yusuf, even though they are on the land of the Kebon Nanas or South Cipinang Besar TPU, some residents have purchased the land parcel from the foundation which used to be the manager of the TPU.

"In our residents, there are some that have been legal buying and selling transactions, on behalf of the foundation and the signature of the heirs (the grave)," said Yusuf.

In fact, several plots of land for residents on the Kebon Nanas TPU land since 2018 have been registered with the Complete Systematic Land Registration program (PTSL).

Dalam proses pengajuan PTSL, pejabat Kelurahan Cipinang Besar Selatan saat itu menandatang bahwa bidang tanah yang diajukan warga bukan lahan Pemprov DKI Jakarta.

There is also a plot of land for residents in the Kebon Nanas TPU area and already has a certificate and a Sale and Purchase Deed (AJB) for their land to build a house.

"Because we have been registered with the National Land Agency (BPN). The management of the 2018 registered PTSL, the Head of Government (Kelurahan) at that time also confirmed that it was not a local government land," he said.

Prior to the plan to control the houses of residents of the Kebon Nanas TPU, East Jakarta City Secretary Eka Darmawan had stated that the Kebon Nanas TPU was not an asset of the DKI Provincial Government.

However, during the socialization process for the return of land for the Kebon Nanas TPU and the Kober Rawa Bunga TPU at the Jatinegara District office on Thursday (20/11), Eka's statement changed.

When asked by residents regarding the ownership of the Kebon Nanas TPU assets, Eka said that the Kebon Nanas TPU is an asset of the DKI Jakarta Provincial Government through the DKI Jakarta City Parks and Forest Service (Tamhut).

"So until now there has been nothing related to the foundation for ownership. Because there is a DKI government building fence in the area," said Eka during the socialization to Thursday (20/11).

Eka said that every funeral service for residents at the Kebon Nanas TPU has always been handled by the DKI City Parks and Forest Service, not foundations or other parties.

So, he said, the Kebon Nanas TPU, which is now partially converted into residential areas, is an asset of the DKI Jakarta City Parks and Forest Service.

"If people die to occupy the tomb, whose permission is it to? To the foundation or local government in charge. We are from the regional government, if that is the local government's asset, we will also maintain it," said Eka.

Eka said the East Jakarta City Government (Jaktim) would investigate the truth regarding the legal sale and purchase transactions and the land sector of residents has been submitted through the PTSL Program.

The East Jakarta City Government (Pemkot) also stated that it would coordinate with BPN to ensure the legality of the residents' land parcels on the Kebon Nanas TPU land to be brought under control.

"We will review it, we will demand the chronology. We do not ignore legal ownership. This means that from the administrative process, what is the head of the signature village! That's why we will examine it later," he said.

Previously, the DKI Jakarta Provincial Government stated that it would restore the function of land at the Kebon Nanas TPU and the Kober Rawa Bunga TPU which had been used for residential areas for decades.

Later, the land used by residents for settlements will be diverted to open new grave plots so that they are expected to overcome the problem of the grave land crisis in Jakarta.

The control of residential areas is carried out because 69 TPU assets of the DKI Jakarta Tamhut Service are full or only serve overlapping funerals.

Based on preliminary data, it was recorded that 280 families (KK) consisted of 517 people who built buildings on the Kebon Nanas TPU land and the Kober Rawa Bunga TPU.
