JAKARTA – President Prabowo Subianto has approved the Draft Law (RUU) concerning Amendments to Law Number 8 of 1981 concerning the Criminal Procedure Code (KUHAP) for enactment into law.
This approval was conveyed by Minister of Law Supratman Andi Agtas during a Plenary Session of the House of Representatives (DPR RI) at the Parliament Complex on Tuesday, October 18th.
The RUU KUHAP was previously approved in a Plenary Session of the DPR after its deliberations were completed by Commission III.
Supratman assessed that the revised KUHAP brings a number of fundamental reforms necessary to adapt the criminal procedure system to current developments.
"On behalf of the President, we express our deepest gratitude and appreciation to the leadership and members of the House of Representatives," Supratman said during the meeting.
He explained that Law Number 8 of 1981, which replaced the HIR (Herziene Inlandsch Reglement), was a milestone in the nation's independence in developing criminal procedural law based on Pancasila and the 1945 Constitution. However, more than four decades have passed, changes in the state administration, advances in information technology, and social dynamics have created new challenges.
According to Supratman, reforming the Criminal Procedure Code (KUHAP) is necessary to make the criminal procedural law system more adaptive, modern, and just.
"We are facing transnational crimes, cybercrimes, and increasing demands for human rights protection," he said.
He hopes that the reform of the KUHAP will make law enforcement more responsive to current developments, fairer for citizens, and firmer in preventing abuse of authority.
Previously, the 18th Plenary Session of the Indonesian House of Representatives (DPR RI) for the Second Session Period of the 2025–2026 Session Year approved the Draft Criminal Procedure Code (RUU KUHAP) for enactment into law.
"Can it be approved as law? Thank you," said House Speaker Puan Maharani, to which all members present immediately responded "yes."
All political party factions in the House also expressed their views and approval of the Criminal Procedure Code Bill finalized by Commission III.
