Legendary High School In Bandung Not To Be Released, West Java Provincial Government Wins Land Lawsuit

BANDUNG - The West Java Provincial Government won an appeal hearing for the Bandung State Senior High School (SMANSA) land dispute which was sued by the Christian Lycheum Association (PLK).

In the decision of the Jakarta State Administrative High Court (PTTUN) with the number PTUN.BDG-04112024CDV issued on September 3, 2025, the panel of judges stated that they received an appeal from the Head of the Bandung City ATR/BPN Land Office and the Head of the West Java Provincial Education Office.

"(The panel of judges) canceled the decision of the Bandung State Administrative Court Number 164/G/2024/PTUN.BDG, dated April 17, 2025, which was requested for an appeal," wrote the verdict seen, quoted from Antara, Thursday, September 4.

In the main case, the court stated that the plaintiff's lawsuit, namely the Christian Lyceum Association (PLK), was unacceptable.

"The court stated that the plaintiff's lawsuit was unacceptable," the verdict said.

In addition, the court also sentenced PLK as a proportional party to pay court fees at the two levels of the judiciary. At the appeal level, the court fee is set at IDR 250,000.

The panel of appeal judges who examined the case consisted of Arif Nurdu'a as chairman, as well as Ariyanto and Sumartanto as members, respectively.

Legal analyst for the Legal Division of the Legal Bureau of the West Java Provincial Government Secretariat, Arief Nadjemudin, confirmed the decision.

“Kita sebagai pemohon pembanding itu ya. Jadi isi putusan amarnya dulu, menerima permohonan banding dari pembanding satu, membatalkan putusan PTUN Bandung. Terus dalam pokok perkaranya menyatakan gugatan penggugat tidak dapat diterima. Artinya, gugatan secara pokok perkaranya ini tidak dapat diterima,” ujar Arief.
