South Jakarta Prosecutor's Office Doesn't Visit The Execution Of The Matutina Silfester, Komjak: Bad Precedent For Law Enforcement

JAKARTA - The South Jakarta District Attorney (PN) has not executed Silfester Matutina even though the court's decision has permanent legal force or inkrah. The Prosecutor's Commission (Komjak) considers this to be a bad precedent for law enforcement in Indonesia.

"That is a bad precedent for law enforcement in Indonesia in the future," said Commissioner of Komjak, Nurukhman, Tuesday, August 12.

Bahkan, jika Kejaksaan Negeri Jakarta Selatan memutuskan untuk menunggu hasil Peninjauan Kembali (PK), hal itu juga akan menjadi contoh bagi para terdakwa lainnya.

Silfester Matutina is known to have officially submitted a PK application on August 5, 2025 at the South Jakarta District Court. The inaugural trial will be held on August 20, 2025.

"It could be that all the convicts ask for the execution to wait for the PK decision, we hope that before the PK trial it will be executed," he said.

Previously, the Attorney General's Office (AGO) stated that the PK proposed by Silfester Matutina would not interfere with the process of execution of detention against him.

"In principle, PK does not delay the execution process," said the Head of the AGO, Anang Supriatna.

Regarding the execution process, Anang had previously stated that the South Jakarta District Attorney would carry out it.

However, it was not conveyed in detail about the time for the execution. It is only mentioned that it will be carried out as soon as possible.

"Regarding the Silfester, this case has been submitted and is under the authority of the South Jakarta District Attorney as the executor prosecutor," said Anang.

For information, referring to the official website of the Supreme Court (MA), Silfester Matutina was sentenced to 1 year and 6 months for a general criminal case in 2019. The verdict has permanent legal force or inkrah.

However, until now, the authorities, namely the South Jakarta District Attorney, have not made an exception even though the decision has permanent legal force since 6 years ago.
