JAKARTA - The Corruption Eradication Commission (KPK) will obey the decision of the Constitutional Court (MK) which states that the process of changing status to state civil servants (ASN) must not be detrimental to employee rights.

"We will comply with the Constitutional Court's decision and will coordinate further with Kemenpan-RB (Ministry of State Apparatus Empowerment and Bureaucratic Reform) and BKN (State Civil Service Agency) regarding the follow-up to the results of the TWK (National Insight Test) to produce employees who are MS (qualified) and TMS (does not meet the requirements)," said KPK Deputy Chairman Nurul Ghufron in his statement as quoted by Antara, Sunday, May 9.

He emphasized that the status transfer process was carried out based on statutory regulations starting from Law (UU) Number 19 of 2019 concerning the Second Amendment to Law Number 30 of 2002 concerning the Corruption Eradication Commission.

Furthermore, Government Regulation Number 41 of 2020 concerning Transfer of KPK Employees to ASN Employees and KPK Regulation Number 1 of 2021 concerning Procedures for Transfer of KPK Employees to ASN Employees.

In addition, on Tuesday, May 4, the Constitutional Court also decided on a judicial review of Law Number 19 of 2019 concerning the Second Amendment to Law Number 30 of 2002 concerning the Corruption Eradication Commission.

"That on May 4, 2021, the Constitutional Court has decided on the JR (judicial review) of Law 19/19 which one of the main points states that the transfer of KPK employees to ASN is legally based on Law Number 19 of 2019 and whatever the process may not be detrimental to employees," said Ghufron.

Therefore, Ghufron emphasized that to date not a single KPK employee has been dismissed from the status transfer process.

"So I need to emphasize that no KPK employee has been dismissed, and we will fight for the process of transferring KPK employees to ASN in accordance with the Constitutional Court's affirmation," he said again.
