Train Line Corruption, Former Director General Of The Ministry Of Transportation Sentenced To 7.5 Years In Prison Plus Replacement Money Of IDR 2.6 Billion

JAKARTA - Director General (Dirjen) of Railways of the Ministry of Transportation (Kemenhub) 2016-2017 Prasetyo Boeditjahjono was sentenced to 7 years and 6 months in prison after being proven to have committed corruption in the Besitang-Langsa railway line construction project at the Medan Railway Engineering Center in 2017 2023.

Chief Justice Syofia Marlianti Tambunan stated that Prasetyo was proven to have received Rp2.6 billion in the case that cost the state Rp562.52 billion.

"The defendant was legally and convincingly proven guilty of committing a criminal act of corruption jointly in the case," said the presiding judge when reading the verdict of the panel of judges during a trial at the Jakarta Corruption Court, Monday, July 21, as reported by ANTARA.

In addition to imprisonment, the Panel of Judges also imposed a fine of Rp. 500 million, provided that if the fine was not paid, it would be replaced (subsidiary) with 4 months imprisonment for Prasetyo.

Not only that, Prasetyo was also sentenced to an additional penalty in the form of payment of replacement money amounting to Rp2.6 billion, provided that if he did not pay the replacement money no later than 1 month after the verdict was obtained, the property of Prasetyo could be confiscated by the prosecutor and auctioned off.

"If property is not sufficient to pay replacement money, then it will be replaced (subsider) with imprisonment for 2 years and 8 months," said the presiding judge.

Thus, Prasetyo was declared to have violated the crime regulated in Article 3 in conjunction with Article 18 of Law (UU) Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption as amended and supplemented by Law Number 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code, as stated in the indictment of a subsidiary public prosecutor.

Before passing the verdict, the Chief Judge stated that there were several aggravating and mitigating things considered by the Panel of Judges, namely a burdensome thing in the form of Prasetyo's actions against the government's efforts to eradicate corruption and have reduced confidence in the government, namely the North Sumatra PP Railway Engineering Center and the Directorate General of Railways of the Ministry of Transportation.

"Another burdensome situation, the defendant has also received the proceeds of a criminal act," said the presiding judge added.

Meanwhile, mitigating factors considered by the Panel of Judges, namely Prasetyo being polite at trial, having responsibility for his family, and being elderly.

The verdict is lower than the demands of the public prosecutor, namely imprisonment for 9 years, a fine of Rp. 750 million, subsidiary to 6 months in prison, and payment of replacement money of Rp. 2.6 billion, subsidiary to imprisonment for 4 years and 6 months.

In this case, Prasetyo was charged with receiving Rp2.6 billion from the beneficiaries of PT Wahana Tunggal Jaya Andreas Kertopati Handoko, through a driver of Rp1.4 billion and a commitment-making official (PPK) Region I at the North Sumatra Regional Railway Engineering Center Akhmad Afif Setiawan worth Rp1.2 billion through Prasetyo's aide, Rian Setianto.

For his actions together with other defendants, Prasetyo was previously suspected of having harmed state finances amounting to Rp1.16 trillion.
