JAKARTA - Deputy Chairperson of the MPR Hidayat Nur Wahid (HNW) responded to the decision of the Constitutional Court (MK) which rejected the lawsuit against the Election Law, one of which requested that the requirements for presidential and vice-presidential candidates be the lowest educated undergraduate or S-1.

HNW said that the diploma requirements with the lowest or highest strata in the Basic Law (UUD) were not regulated.

"Indeed, when referring to the Basic Law, there are no requirements for diplomas in the lowest or highest strata," said HNW at the DPR building, Friday, July 18.

"So if someone then requires a certain minimum, it is natural for the Constitutional Court to refuse because the Basic Law does not limit," he continued.

However, HNW considers that there must be an affirmation regarding the minimum qualifications of presidential and vice presidential education. Although the Constitutional Court does not have the authority to make laws, according to him, the DPR RI needs signs set by the constitution in making laws.

"What kind of diploma requirements are at least important, that's what matters. Even though the Constitutional Court is not a legislator, it is also important to give signs so that when the DPR makes a law, it should not be deemed against the constitution again because there are restrictions. But once again, if the constitution measures there is no minimum limit on the diploma, what status," explained the PKS legislator.

On the other hand, HNW assessed that the DPR as a legislator must be wiser. Because he said, the majority of ASN who work in Indonesia only have the requirements to have a bachelor's degree.

"So in my opinion, the DPR needs to be wiser, including later it will also determine the threshold, right. The threshold is indeed 0% for presidential candidates, while in the DPR there are minimal requirements," he concluded.
