JAKARTA - Former Civil Servant (PNS) of the Ministry of Forestry Chairul Syamsuddin filed a lawsuit with the Jakarta State Administrative Court (PTUN) because his Pension Decree (SK) was not issued by the ministry since 2012.

However, said Parluhutan, the State Civil Service Agency (BKN) and the Ministry of Transportation refused to issue their client's pension decree on the grounds that his client had been dishonorably dismissed because he was known to be registered as a candidate for the DPR RI in 2004.

According to him, his client resigned as a legislative candidate on April 10, 2004, but the KPU has not yet received his resignation letter.

Then, MS Ka'ban (as Minister of Transportation at that time) had restored Chairul Syamsuddin as a civil servant of the Ministry of Transportation with the issuance of SK.149/Menhut-II/2005 dated June 2, 2005.

MS Ka'ban also canceled the decree regarding the dishonorable dismissal of Chairul Syamsuddin after receiving a letter from KPU No. 373/15/V/2005 dated May 12, 2005, which stated that Chairul Syamsuddin's resignation letter as a candidate from the Star Reform Party had been received by the KPU.

"Mr. MS Ka'ban himself came as a witness at the trial at the Jakarta Administrative Court on July 2, 2025. He admitted that he had restored the status of our client's civil servants. So it means that there is not the slightest barrier or that hinders the pension decree from Chairul Syamsuddin. This must be issued by the Minister of Forestry," said Parluhutan.

However, he regretted that expert witnesses from the Ministry of Transportation were not present at the trial.

"Next week, expert witnesses from the Ministry of Forestry and BKN will be presented. We hope that it will no longer be delayed. We are very disappointed," he said.

According to Parluhutan, this case did not escape the attention of the Special Staff of the Vice President of the Republic of Indonesia for Law 2009-2025, Satya Arinanto.

In fact, Satya Arinanto is said to be willing to become an expert witness in the trial on July 2, 2025, which in his opinion has given a legal opinion.

"MS Ka'ban is also willing to be a fact witness and there is Prof. Dr. Satya Arinanto, SH, MH, UI Professor and he is currently an expert staff of the Vice President willing to become an expert witness. So those who come sympathize with his fate," he added.

The panel of judges chaired by Himawan Krisbiantoro SH decided that the trial would continue on Wednesday, July 16, 2025, because expert witnesses from the Ministry of Law and Forestry were not present.

"Our trial is postponed next week, Wednesday (July 16) by examining expert witnesses from the Ministry of Transportation," he said.
