Asset Confiscation Bill, Coordinating Minister Yusril Ready: Stay DPR Mau Or Not

JAKARTA - Coordinating Minister for Law, Human Rights, Immigration and Corrections Yusril Ihza Mahendra emphasized that the government is ready to discuss the Asset Confiscation Bill (RUU). But currently, we are still waiting for the readiness of the DPR.

"The government is at any time ready to discuss the Asset Confiscation Bill whose initiative has been proposed by the DPR since 2023," said Yusril, quoted on Sunday, May 4.

This was conveyed by Yusril following up on President Prabowo Subianto who stated that he supports the completion of the Asset Confiscation Bill during a speech at the celebration of International Labor Day or May Day at Monas Square, Jakarta, last week.

Yusril said the confiscation of assets resulting from corruption must be strictly regulated in a special law so that judges have a strong legal basis in making decisions.

"When the assets suspected of being the result of corruption can be confiscated and when to be confiscated for the state, all must be regulated by law in order to create justice and legal certainty and respect for human rights," explained the constitutional law expert.

In addition, said Yusril, the Asset Confiscation Law is also important to prevent abuse of power and arbitrary actions by law enforcement officials.

"Law enforcement in the confiscation of assets must be carried out firmly, but still respects the principles of justice, legal certainty, and human rights," said Yusril regarding the Asset Confiscation Bill.

Furthermore, Yusril alluded to a similar experience during the discussion of the Criminal Procedure Code proposed by the DPR during the administration of President Joko Widodo (Jokowi). At that time, the DPR made a revision and improvement of the academic text before discussing it with the government.

"There is a possibility that the DPR will do the same with the Asset Confiscation Bill which was proposed in the era of President Jokowi and will only be discussed during the current President Prabowo Subianto," he said.

Yusril also expressed that President Prabowo's commitment to eradicating corruption was very strong. This can be seen in various official statements, including during the commemoration of Labor Day.

Moreover, he said, the Asset Confiscation Bill is in line with the United Nations Convention on Corruption Eradication (United Nations Convention Against Corruption) which was ratified by Indonesia in 2006.

"The trade can not only be carried out on assets resulting from corruption in the country, but also on assets abroad," concluded Yusril regarding the Asset Confiscation Bill.
