SURABAYA - The East Java Provincial Government issued a circular (SE) prohibiting the practice of age discrimination in the labor recruitment process.
Regional Secretary of East Java Province, Adhy Karyono said this policy was an initiative of the Governor of East Java Khofifah Indar Parawansa in commemoration of International Labor Day and encouraging justice and equality of job opportunities in the regions.
"The phenomenon of age discrimination in job vacancies is now a serious problem in the employment sector," he said as quoted by ANTARA, Saturday, May 3.
According to him, many job seekers over the age of 35 have difficulty getting a job despite their experience and adequate competence.
"There is a serious problem that concerns the governor. Many workers are of productive age, especially over 35 years old, who experience discrimination in the recruitment process," said Adhy.
This policy, he said, is in line with the mandate of the constitution and a number of national regulations and international conventions that emphasize the principle of non-discrimination in the world of work.
Through this SE, the East Java Provincial Government encourages the business world to no longer include age restrictions that are irrelevant in job vacancies, as well as prioritize the competency-based recruitment system and equality of opportunities.
"It is hoped that East Java can become a pioneer in creating a fair and inclusive job market," said Adhy.
This policy also targets disability groups, who are said to have the same rights and opportunities to apply for jobs as long as they meet the required qualifications.
The SE also strengthens the implementation of Law Number 13 of 2003 concerning Manpower, especially articles 5 and 6 which guarantee equal treatment for each workforce.
In addition, referring to Law Number 21 of 1999 concerning the ratification of the ILO Convention Number 111, the government prohibits discrimination in work and position, including by age.

Law Number 23 of 2014 concerning Regional Government also stipulates that employment is part of a concurrent matter that is the authority of the Regional Government to provide guidance and facilitation through administrative policies.
"Through this SE, the governor encourages the business world to eliminate irrational age terms, unless needed for safety reasons or valid technical considerations," he added.
As a form of initial implementation, the East Java Provincial Government ensures that this SE will be implemented in all Regional Owned Enterprises (BUMD), government partner service providers, labor-intensive programs based on regional revenue and expenditure budgets (APBD), as well as in the recruitment process of state civil servants (ASN) non-PNS and government employees with work agreements (PPPK) in the provincial environment.
