PSU Pilkada Lawsuit Session After Complete Files, MK Make Sure It's Broadcast Openly

JAKARTA - Head of the Public Relations and Protocol Bureau of the Constitutional Court (MK) Pan Mohamad Faiz said the trial of the lawsuit on the results of the 2024 Regional Head Election (Pilkada) will begin after all application files are declared complete and registered.

"The trial will begin after all the files are declared complete and have been registered. There will be a summons for the parties to attend the preliminary hearing," said Faiz when contacted, Friday, April 18, as quoted by Antara.

Faiz has not disclosed the schedule for the initial trial for the PSU lawsuit case. However, he ensured that the trial schedule would be announced openly to the public.

"The trial at the Constitutional Court will also be broadcasted openly and live again," he added.

It was also explained that the trial for case examination will continue to use the panel trial mechanism. The composition of the constitutional judges for each panel is predicted to not change from the composition when the trial of the 2024 Pilkada results lawsuit took place from January to February.

That way, the composition of judges to examine the PSU lawsuit case, namely Panel I led by Suhartoyo together with Daniel Yusmic P. Foekh and M. Guntur Hamzah, Panel II led by Saldi Isra with Ridwan Mansyur and Arsul Sani, while Panel III was led by Arief Hidayat with Anwar Usman and Enny Nurbaningsih.

"Unless there is a constitutional judge who is unable to adjust his composition," Faiz added.

As of Friday, April 18 at 16.30 WIB, there were seven applications related to the lawsuit that the results of the PSU had been received by the Constitutional Court. All the applications that came in questioned the results of the PSU for the election of the regent and deputy regent.

The seven applications, among others, were requested by Miren Kogoya and Mendi Wonerengga (Candidates for regent and deputy regent of Puncak Jaya, Central Papua, serial number 2); Sugianto (Candidate for deputy regent of Siak, Riau, serial number 1); and Gogo Purman Jaya and Hendro Numbleelo (Candidates for regent and deputy regent of North Barito, Central Kalimantan, number 1).

Then, Amus Besan and Hamsah Buton (Candidate for regent and deputy regent of Buru, Maluku, serial number 4); Citra Puspasari Mus and La Utu Ahmadi (Candidate for regent and deputy regent of Talibu Island, North Maluku, serial number 2); Sulianti Murad and Samsul Bahri Mang (Candidate regent and deputy regent of Banggai, Central Sulawesi, serial number 3); as well as Irwan Hasan and Haroni Mamentiwalo (Candidate regent and deputy regent of the Talaud Islands, North Sulawesi, serial number 2).

The deadline for filing a lawsuit on the results of the PSU is the same as the provisions in the lawsuit on the results of the regional elections, which is submitted no later than three working days after the announcement of the vote acquisition by the KPU in each region that organizes the PSU.

However, said Faiz, the Constitutional Court will always open the application for a lawsuit against the results of the PSU. The constitutional judge will judge whether or not an application is binding.

"The assessment of his petition, including the fulfillment of the terms of the grace period, will fully become the domain of the panel of judges to assess it," said Faiz.
