KAI Project Corruption, Former Director General Of The Ministry Of Transportation Charged With Receiving IDR 2.6 Billion

JAKARTA - Director General (Dirjen) of Railways of the Ministry of Transportation (Kemenhub) 2016-2017 Prasetyo Boeditjahjono was charged with receiving Rp2.6 billion in cash related to the corruption case of the Besitang-Langsa railway line construction project at the Medan Railway Engineering Center in 2017 2023.

The public prosecutor (JPU) of the Attorney General's Office (Kejagung) Lina Mahani Harahap said the money was received from the beneficiaries of PT Wahana Tunggal Jaya Andreas Kertopati Handoko through a driver of Rp1.4 billion and a commitment-making official (PPK) Region I at the North Sumatra Region Railway Engineering Center Akhmad Afif Setiawan worth Rp1.2 billion through Prasetyo's aide, Rian Sestianto.

"His actions together with other defendants have harmed state finances amounting to Rp1.16 trillion," said the public prosecutor in a trial reading the indictment at the Jakarta Corruption Court (Tipikor), Monday, March 17, as reported by ANTARA.

The prosecutor revealed that the case began when Prasetyo ordered the Head of the North Sumatra Regional Railway Engineering Centerex officio as the power user of the 2016-2017 period, Nur Setiawan Sidik, to propose a project to build the Besitang-Langsa railway line.

The project will be financed through the issuance of State Sharia Securities-Project Based Sukuk (SBSN-PBS) for Fiscal Year (TA) 2017 to the National Development Planning Agency (Bappenas). In fact, there are still requirements that have not been met, among others, the results of the DED-10 package design review have not been submitted by the Expert Team Leader of PT Dardella Yasa Guna Arista Gunawan to PPK and KPA.

The results of the design review also have not received approval from the Director of Railway Infrastructure at the Directorate General of Railways at the Ministry of Transportation.

Other requirements that have not been met, namely that there has been no determination of a route from the Minister of Transportation, no pre-feasibility study (preliminitary feasibility study) and feasibility study (feasibility study), no environmental impact analysis (AMDAL) has been carried out, and no land acquisition has been carried out.

In addition, the project is also suspected to be not equipped with a work reference framework, budget plans, technical specifications, and project feasibility study documents, and is not listed in the 2017 FY Government Work Plan (RKP) based on Presidential Regulation Number 45 of 2016 concerning Government Work Plans in 2017.

After that, Nur Setiawan divided the activity into 11 packages of construction work for the construction of the Besitang-Langsa railway line with a value below Rp. 100 billion with the aim of avoiding the provisions of the complex work and ordering the Head of the Infrastructure Section at the 2016-2018 North Sumatra Regional Railway Engineering Center Rieki Meidi Yuwana to conduct auctions using the post-qualification assessment method.

Furthermore, Prasetyo, Nur Setiawan, Akhmad Afif, Rieki, as well as beneficiaries of PT Tiga Putra Mandiri Jaya and PT Mitra Kerja Prasarana (MKP) Freddy Gondowardojo are suspected of arranging the winner of the auction for the construction work for the Besitang-Langsa railway for the BSL-1 package to BSL-11.

Arrangements by meeting with potential winners and providing information related to work methods and including the requirements for support from Multi Tamping Tier (MTT) owners, which are equipped with proof of ownership and purchase invoices, while these conditions can only be met by PT MKP owned by Freddy.

As a form of commitment costs to the victory of several companies in construction and supervision work packages, Prasetyo, Nur Setiawan, Akhmad Afif, PPK Construction Work on the Construction of the Besitang-Langsa Railway for the 2019 '2022 period Halim Hartono and Rieki received gifts in the form of money, goods, and facilities from Freddy and Arista.
