Banjarmasin District Court Sentenced 2.5 Years In Prison 2 Contractors In South Kalimantan PUPR Corruption Case

SOUTH KALIMANTAN - Chairman of the Panel of Judges at the Banjarmasin District Court (PN) Cahyono Riza Adrianto sentenced the defendants Andi Susanto and Sugeng Wahyudi as two contractors for corruption in the South Kalimantan Public Works and Spatial Planning (PUPR).

"The defendant was also sentenced to a fine of Rp. 250 million and if it was not paid, the sentence of imprisonment was replaced by three months," said Cahyono when reading the verdict of the Corruption Court at the Banjarmasin District Court, Thursday, March 6, which was confiscated by Antara.

The judge assessed that the defendant was legally and convincingly proven to have committed a criminal act of corruption as the first alternative indictment of Article 5 paragraph 1 letter b of Law number 31 of 1999 as amended by Law Number 20 of 2001 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph (1) of the 1st Criminal Code.

After reading the verdict, the two defendants expressed their thoughts in line with the Corruption Eradication Commission (KPK) public prosecutor team which was given time for the panel of judges for the next seven days.

KPK public prosecutor Meyer Simanjuntak's team after the trial admitted that he appreciated the judge's decision.

Although lower than the previous KPK demand, namely imprisonment of 3 years and 5 months in prison and a fine of Rp. 250 million, subsidiary of 6 months in prison, he stated that the judge's verdict had shown that what was charged was proven.

"With this decision, we are thinking about taking the next legal step," he explained.

It is known that the two defendants gave something in the form of Rp1 billion to the former Head of PUPR Office of South Kalimantan Ahmad Solhan because they had chosen their company to work on the work package of the South Kalimantan PUPR Service in 2024.

A prize of Rp1 billion in cash related to the construction project of the Integrated Samsat Building on Jalan Ahmad Yani Km 17, Gambut District, Banjar Regency was carried out by PT Haryadi Indo Utama (HIU) with a value of Rp22,268,020,250.

Two other projects, namely the construction of a soccer field in the integrated Sports area of South Kalimantan Province amounting to Rp23,248,949,136 with the provider PT Wismani Kharya Mandiri (WKM) and the construction of a swimming pool at a cost of Rp9,178,205,930, the selected provider of CV Bangun Banua Bersama (CBB).
