KPK Prosecutor Indicts Former Langkat Regent Terbit Warin-Angin Receives Bribe Of IDR 68.4 Billion

The Public Prosecutor (JPU) of the Corruption Eradication Commission (KPK) charged the former Regent of Langkat, North Sumatra, with the issuance of a War Plan with his brother Iskandar Warin-Angin to accept bribes of more than Rp68.4 billion.

"The two defendants received bribes of Rp68,402,393,455 for securing a number of projects in the Langkat Regency Government from the 2020 to 2021 fiscal years," said KPK prosecutor Johan Dwi Junianto at the Corruption Court at the Medan District Court, Monday, February 3.

The two defendants made arrangements for projects carried out by a number of agencies in the Langkat Regency Government, such as the Public Works and Spatial Planning Service (PUPR).

Then, the Housing and Settlement Areas Office, the Education Office, the Health Service, the Industry and Trade Service, as well as the Marine and Fisheries Service.

Supposedly, the defendant Terbit and a number of service heads should carry out supervision through audits of reviews, monitoring, and evaluation of infrastructure projects and procurement of goods/services.

"Both direct and indirect. In fact, the defendant directed or made arrangements, and determined the winner of the project work before the direct procurement work process in a number of Langkat Regency Government services," Johan explained.

In the implementation of the procurement of goods/services, either by auction or tender or direct appointment for the 2020-2021 fiscal year, he continued, the defendant Terbit gave directions to each head of service at home or stall around the defendant's house.

In the process, the defendant Iskandar Warin-Angin, who at that time served as the Head of Raja Tengah Village, Kuala District, Langkat Regency, arranged all work packages or projects for a number of agencies in the Langkat Regency Government.

In addition, the working group (pokja) will also look for the slightest error from other companies that participate in the auction at a number of agencies in the Langkat Regency Government.

If the administrative evaluation stage, then technical evaluation, and evaluation of the price of the offer, there are other companies that get high points and the best offers, then Marcos Surya Abdi is a confidant of the two defendants trying to get the other company outside the 'joint' list and not coming during the re-verification process.

"So that only companies listed the 'penantin' list are present, and the tender process or procurement of goods/services is carried out on all tenders or procurement of work packages within the Langkat Regency Government," said Johan.

The KPK prosecutor also revealed that companies that have been won to work on a project are required to submit a fee or money of 15.5 percent to 16.5 percent of the contract value to the defendants.

For their actions, the Public Prosecutor explained, the two defendants were charged with Article 12 letter i in conjunction with Article 18 of Law Number 31 of 1999 which was amended by Law Number 20 of 2001 concerning the Eradication of Criminal Acts of Corruption as the first indictment.

"The two defendants were also charged with violating Article 12 B in conjunction with Article 18 of Law Number 31 of 1999 which was amended by Law Number 20 of 2001 concerning Eradication of Corruption in conjunction with Article 55 paragraph (1) 1st of the Criminal Code in conjunction with Article 65 paragraph (1) of the Criminal Code," said Public Prosecutor Johan.

After listening to the indictment, Chief Judge As'ad Rahim Lubis postponed the trial and continued next week with the agenda of reading the objection note or exception from the two defendants.

"The trial was postponed and continued on Monday (10/2), with the exception agenda of the two defendants and their legal advisors," said Judge As'ad.
