Justice Collaborator Denied, Prosecutor Harry Sidabukke 4 Years In Prison

JAKARTA - KPK prosecutors demanded that Harry Van Sidabukke be in prison for 4 years plus a fine of Rp. 100 million, subsidiary to 4 months in prison for bribing former Social Minister Juliari Peter Batubara for Rp1.28 billion.

Bribes were given in the appointment of PT Pertani (Persero) and PT Mandala Hamonangan Sude (MHS) as companies providing social assistance (bansos) for COVID-19 staples.

"Demand that the panel of judges at the corruption court (Tipikor) declare that the defendant Harry Van Sidabukke is legally and convincingly proven guilty of continuing corruption. Imposing the defendant to 4 years in prison plus a fine of Rp. 100 million, subsidiary to 4 months in prison," said the prosecutor. KPK public prosecutor Muhammad Nur Azis at the Jakarta Corruption Court (Tipikor), reported by Antara, Monday, April 19.

The charge is based on the first indictment of article 5 paragraph 1 letter b of Law No. 31 of 1999 as amended by Law No. 20 of 2001 concerning Eradication of Corruption in conjunction with Article 64 paragraph 1 of the Criminal Code.

"What is burdensome is that the defendant's actions did not support the government's program in realizing a government that is clean from corruption, collusion and nepotism. The defendant's corruption act was committed during a national disaster, namely COVID-19. What relieves him is that the defendant regrets his actions," added prosecutor Azis.

The KPK also rejected Harry's request to be identified as a perpetrator who cooperates with law enforcement or a "justice collaborator".

"The public prosecutor concluded that the status of 'justice collaborator' could not be granted in the a quo case because the defendant had not provided very significant information regarding the actions or roles of other people," said Prosecutor Ikhsan Fernandi.

In this case, Harry is considered proven guilty of bribing Juliari P Batubara with a total value of Rp1.28 billion in connection with the appointment of PT Pertani (Persero) and PT Mandala Hamonangan Sude (MHS) as providers of social assistance for COVID-19 staples 1, 3, 5, 6, 7, 8, 9 and 10, totaling 1,519,256 packages.

Bribes were given through two of Juliari's men, namely Matheus Joko Santoso as the Commitment Making Officer (PPK) for the procurement of COVID-19 basic food assistance at the Directorate of Social Protection for Social Disaster Victims of the Ministry of Social Affairs for the period of April-October 2020 and Adi Wahyono as the Head of General Bureau of the Ministry of Social Affairs and PPK for the procurement of COVID-19 basic food assistance. -19 October-December 2020 period.

It is known that PT MHS does not meet the qualifications as a provider of social assistance for COVID-19 so Harry meets Lalan Sukmaya as the Operational Director of PT Pertani (Persero) who has been appointed as one of the providers of social assistance goods since April 15, 2020.

The meeting took place on April 16, 2020 at the PT Pertani office. Lalan also agreed that Harry would supply non-rice goods carried out by PT Pertani with the agreement that operational costs in any case with outside parties would be Harry's responsibility.

In stage 1, PT Pertani (Persero) received a package quota of 90,366 packages. Then on May 1, 2020, Harry gave Rp. 100 million in Singapore dollars to Matheus Joko Santoso at his office.

In stage 3, PT Pertani (Persero) again received a package quota of 80,177 packages and a community package of 50,000 packages so that Harry gave Rp. 100 million in Singapore dollars to Matheus Joko Santoso at his office on June 3, 2020.

In stage 5, PT Pertani (Persero) received a quota of social assistance packages of 75,000 packages, so that in early June 2020 Harry again gave a "fee" of Rp. 100 million in Singapore dollars to Matheus Joko Santoso.

In stage 6, PT Pertani (Persero) again received 150,000 packages, Harry also gave Rp. 100 million in Singapore dollars in mid-June 2020 to Matheus.

In stage 7, PT Pertani (Persero) received a quota of 160,000 packages so that Harry gave Rp180 million as a "fee" to Matheus. Harry also gave Adi Wahyono a "fee" of Rp. 50 million.

In stage 8, PT Pertani and PT MHS received a social assistance quota of 188,713 packages so that Harry gave a "fee" of Rp150 million to Matheus Joko Santoso at the Boscha Cafe.

In stage 9, PT Pertani and PT MHS received a quota of 200,000 packages, Harry then handed over a "fee" of Rp. 200 million in September 2020 to Matheus Joko Santoso through his driver named Sanjaya in the Kemensos parking lot. Harry also gave Rp. 50 million to Matheus in September 2020 at Club Raia Senayan and Rp. 50 million to Adi Wahyono in Adi's office.

In stage 10, PT Pertani and PT MHS received a quota of 175,000 packages so that Harry gave a "fee" of Rp. 200 million in the parking lot of the Ministry of Social Affairs in October 2020 to Matheus via Sanjaya.

Regarding these demands, Harry will submit a plea note on Monday, April 26, 2021.
