JAKARTA - Chairman of the Constitutional Court (MK) Suhartoyo said the maximum number of witnesses and experts who could be presented in the trial of evidence for the dispute over the election of six people (pilgub), while the dispute over the election of the regent (pilbup) and the election of the mayor (pilwakot) were four people.

"This can be combined between witnesses and experts, as long as it does not exceed the maximum earlier: for provinces six and for regencies/cities four," Suhartoyo said during a follow-up hearing on the 2024 Pilkada dispute at Panel I at the Constitutional Court, Jakarta, Thursday, January 23, which was confiscated by Antara.

The witnesses and experts can only be submitted by parties whose cases are declared not to have died. Based on the Constitutional Court Regulation Number 14 of 2024, the trial for reading the verdict is whether or not a case or called a dissal decision is planned for 11'13 February 2025.

"The list of identities, witness statements, expert statements, and CV is submitted to the Constitutional Court no later than 1 working day before the trial of evidence. Then, related to inzage (checking completeness or studying case files), this can only be done after the case is confirmed to be at the evidentiary stage," added Suhartoyo.

Meanwhile, Deputy Chief Justice of the Constitutional Court, Saldi Isra, who chaired the Panel II session, explained that the composition of witnesses or experts to be presented depends on the needs of each party. Especially for experts, they must obtain permission from superiors.

"So, all witnesses may, all experts may, all in half," he said.

The trial of the proof is scheduled for February 14' 28, 2025. In the trial, the panel of judges at the Constitutional Court will listen to the testimony of witnesses and experts as well as examine and ratify additional evidence.

After that, on March 3, 2025, the panel will hold a panel of judges (RPH) to discuss the results of the trial of evidence and draw up a decision. The trial for expressing the final decision of the 2024 Pilkada dispute is planned for March 7, 2025.

It is known that the total cases of regional election disputes or also known as disputes over the results of the election of governors, regents, and mayors (PHP regional heads) in 2024 reached 310 cases. This number consists of 23 cases of governor election, 238 cases of regent election, and 49 cases of mayor election.
